The role of the court's notice of closing the case

Legal analysis: the notice of assistance in execution refers to a legal document in which the people's court notifies the relevant units or citizens to complete the assistance designated by the people's court according to the needs of the case.

The notice of assistance in execution itself can be an independent legal document, or it can be called different documents according to the different matters of assistance in execution, such as the notice of assistance in checking deposits, the notice of assistance in freezing deposits, the notice of assistance in unfreezing deposits, the notice of the object of border control, the notice of designated custody and seizure of property, and the notice of ordering to recover money and materials within a time limit.

The notice of assistance in execution is generally a legal document filled in, not a written narrative document, that is, it is filled in according to the provisions of the Supreme People's Court or the preface of courts at all levels in the process of execution. So its format and content are relatively fixed.

At the same time, the notice of property declaration within a time limit is also called the notice of property declaration. After accepting the execution case, the Municipal People's Court shall order the person subjected to execution to truthfully declare his property to the people's court. Its formulation is based on Article 28 of the Provisions of the Supreme People's Court on Several Issues Concerning the Implementation of People's Courts.

When making this notice, the people's court shall also make a property declaration form and serve it on the person subjected to execution.

Article 259 Basis of implementation

Judgments and rulings shall be executed after they become legally effective. The following judgments and rulings take legal effect:

(a) there is no appeal or protest judgment or ruling within the statutory time limit;

(2) Final judgment and ruling;

(three) the death penalty approved by the Supreme People's Court and the death penalty approved by the Higher People's Court are suspended for two years.
