Is there any way to avoid drunk driving detention?

According to the law, drunk driving belongs to administrative detention. After the public security organ decides on administrative detention, it shall immediately execute it. However, if the conditions prescribed by law are met, if the person who is detained and punished suffers from a serious illness and cannot take care of himself, he may not be detained.

Legal basis:

Measures for the Implementation of the Regulations on Detention Facilities Article 18 If a detainee is under any of the following circumstances, the detention facility shall not accept him, and issue a Notice of Refusal to Accept him, informing the organ that decided to accept him:

(a) under the age of 65-438+06 or over the age of 70;

(2) Having reached the age of 16 but under the age of 18, and violating the administration of public security for the first time;

(3) Being pregnant or nursing a baby under one year old;

(4) The person detained for examination is seriously ill;

(five) other circumstances that are not suitable for detention review.

If the detainee is found to have one of the above circumstances after detention, the detention center shall immediately issue a notice of further treatment and notify the detention decision-making organ. The detention decision organ shall immediately deal with it and notify the detention center.

Nineteenth in custody or after detention, the detention center found that the detainee has one of the following circumstances, it shall issue a notice, suggesting that the detention decision-making organ make a decision to stop the execution of detention:

(a) suffering from mental illness or infectious diseases need isolation treatment;

(2) Serious illness may endanger life safety;

(three) life can not take care of themselves;

(4) Failing medical treatment due to illness and being incurable in a short period of time.

The detention decision organ shall immediately decide whether to stop the execution of detention and notify the detention center.
