The Notice issued by the Ministry of Labor [2014]15 on the "Answers to Issues Related to Labor Contracts in the Implementation of the Labor Law" stipulates that employees who are on medium- and long-term sick leave, long vacations and early retirement (note (permanent employee), he is still an employee of the enterprise and maintains a labor relationship with the employer. During long-term sick leave, it is still necessary to go through the leave renewal procedures with a sick leave proposal. The unit's labor appraisal committee (group) or labor and personnel department should regularly review employees on long-term sick leave, and the review interval should not exceed 3 months. Generally, long-term sick leave is granted for a medical period of three months to 24 months.

(1) If the actual working experience in the unit is less than ten years, it is three months if the actual working experience in the unit is less than five years; and it is six months if the actual working experience is more than five years.

(2) For those with actual working experience of more than ten years, six months for those with less than five years of working experience in the unit; nine months for those with more than five years and less than ten years; and fifteen years for those with more than ten years of service. The period below is twelve months; the period between fifteen and twenty years is eighteen months; the period above twenty-four years is twenty-four months.

(3) If the medical treatment period is three months, the accumulated sick leave time within six months shall be calculated as the accumulated sick leave time within six months; if the medical treatment period is six months, the accumulated sick leave time shall be calculated as twelve months; if the medical treatment period is nine months, the accumulated sick leave time shall be calculated as fifteen months. The accumulated sick leave time within 12 months is calculated as the accumulated sick leave time within 18 months; the accumulated sick leave time within 18 months is calculated as the accumulated sick leave time within 24 months; the accumulated sick leave time within 24 months is calculated as 30 months The accumulated sick leave time within the period is calculated. If the sick leave exceeds the prescribed medical period, the position level needs to be re-evaluated. After the medical period, the relevant national regulations will be followed. Salary payment standards for employees during sick leave: Those who have a continuous medical period of less than 6 months and have worked in the company for less than 2 years will receive 60% of their salary; those who have worked for more than 2 years but less than 4 years will have 70% of their salary; those who have worked for more than 4 years If the employee has been employed for less than 6 years, the employee’s salary will be 80%; for those who have been employed for 6 years but less than 8 years, it will be 90% of the employee’s salary; for those who have been employed for 8 years or more, it will be 100% of the employee’s salary. When the continuous medical treatment period exceeds 6 months, according to the provisions of Article 13, Paragraph B, of the Labor Insurance Regulations, the sick and injury holiday wages are suspended, and the sickness or non-work-related injury relief is paid on a monthly basis from the labor insurance fund instead. The standards are as follows: Those who have worked in the company for less than one year will receive 40% of their salary; those who have worked for one year but less than three years will receive 50% of their salary; those who have worked for three years or more will receive 60% of their salary.
