The term "network car platform company" as mentioned in these Measures refers to an enterprise legal person that builds a network service platform and engages in network car management services.

Chapter II Network Car Platform Company

Article 6 Anyone who applies for online carpooling within the administrative area of this Municipality shall apply to the road transport management institution and submit the following materials:

The road transport management institution shall make a decision of approval or disapproval within 20 days from the date of acceptance. If a decision cannot be made within 20 days, 10 days may be extended with the approval of the person in charge of the road transport management institution, and the applicant shall be informed of the reasons for the extension.

Article 8 Where a road transport management institution makes an administrative licensing decision on the application for online car rental, it shall specify the business scope, business area and business period, and issue a license for online car rental.

Article 9 Where a road transport management institution decides not to grant an administrative license to an application that does not meet the prescribed conditions, it shall issue a written decision not to grant an administrative license to the applicant.

Article 10 A network car rental platform company shall obtain a network car rental business license, and apply to the provincial transportation department where the enterprise is registered for Internet information service for the record before it can carry out related business. Involving the operation of telecommunications business, it shall also comply with the relevant provisions of telecommunications management.

Article 11 If the network car platform company suspends or terminates its operation, it shall report in writing to the road transport management institution where the service is located 30 days in advance, explain the relevant situation, notify the vehicle owners and drivers who provide the service, and make an announcement to the public. Chapter three. Vehicles and drivers of the network car

Article 12 A vehicle that intends to engage in online car rental business shall meet the following conditions:

(3) The technical performance of the vehicle meets the requirements of relevant operational safety standards;

Article 14 Anyone who applies for booking a taxi transport license online shall apply to the road transport management institution of the county (autonomous county) where the address of the vehicle owner registered in the motor vehicle driver's license belongs, and submit the following materials:

(1) An application form for booking a taxi transport permit online;

(2) The original and photocopy of the motor vehicle driving license and motor vehicle registration certificate;

Article 16 Vehicles engaged in online car rental business shall comply with the following provisions:

(1) It is not allowed to set the same or similar vehicle appearance color and vehicle logo as the parade taxi;

(2) No special service facilities and equipment for cruise taxis, such as overhead lights, no-load lights and meters, shall be installed;

(3) The satellite positioning device installed on the network car is directly connected with the government supervision platform.

Chapter IV Operating Behavior of Online Car Rental

Article 20 The network car platform company is the provider of transportation services, and undertakes the carrier's responsibilities and corresponding social responsibilities, ensuring operational safety and safeguarding the legitimate rights and interests of passengers.

Article 21 The online car rental platform company shall ensure that the vehicles providing services have legal operating qualifications, good technical conditions, reliable safety performance and insurance related to operating vehicles, ensure that the vehicles providing services online are consistent with the vehicles actually providing services offline, and report the relevant information of vehicles to the road transport management institution where the services are located.

Article 22 The online car rental platform company shall ensure that the drivers who provide services have legal qualifications, and sign various forms of labor contracts or agreements with drivers according to the provisions of relevant laws and regulations and the characteristics of working hours and service frequency, so as to clarify the rights and obligations of both parties. Network car platform companies should safeguard and protect the legitimate rights and interests of drivers, and carry out pre-job training and daily education on relevant laws and regulations, professional ethics, service standards and safe operation. , to ensure that the drivers who provide services online are consistent with the drivers who actually provide services offline, and report the driver's relevant information to the road transport management institution where the service is located.

Twenty-fifth car platform companies shall not hinder fair competition in the market, and shall not infringe upon the legitimate rights and interests of passengers and public interests.

The network car platform company shall not engage in unfair price behaviors such as crowding out competitors or monopolizing the market, operating at a price lower than the cost, disrupting the normal market order, damaging the national interests or the legitimate rights and interests of other operators, and shall not commit price violations.

Article 26. The network car should engage in business activities within the licensed business area. Beyond the licensed business area, one end of the starting point and the end point shall be within the licensed business area.

The network car is not allowed to engage in fixed line transportation in the way of preset destination.

Twenty-seventh network car platform companies should pay taxes according to law, buy carrier liability insurance and other related insurance for passengers, and fully protect the rights and interests of passengers.

Article 28 A car sharing platform company shall strengthen safety management, implement safety precautions such as operation and network, strictly protect and manage data safety, improve safety precautions and risk resistance, and support and cooperate with relevant departments to carry out related work.

Article 29 The company and drivers of the online car platform shall provide business services in accordance with the relevant national operational service standards, and shall not abandon passengers halfway or deliberately detour, charge fees in violation of regulations, or retaliate against passengers who report, complain about their service quality or make unsatisfactory comments on their services.

Thirtieth online car rental platform companies should inform the purpose, method and scope of collecting and using personal information such as drivers, car owners and passengers in a significant way through their service platforms. Without the explicit consent of the information subject, the network car platform company shall not use the above personal information for other businesses.

The network car platform company shall not collect personal information of drivers, car owners and passengers beyond the necessary scope of providing network car service.

In addition to cooperating with state organs to exercise supervision and inspection rights or criminal investigation rights according to law, the online car platform company shall not provide any third party with personal information such as its name, contact information, home address, bank account or payment account, geographical location and travel route. Chapter V Supervision and Inspection

Chapter VI Legal Liability

It is forbidden for carpooling information service platform companies and carpooling service providers to carry out road transport business activities in the name of carpooling.

Article 50 The main urban areas mentioned in these Measures include Yuzhong District, dadukou district, Jiangbei District, Shapingba District, Jiulongpo District, Nan 'an District, Beibei District, Yubei District, Banan District and Liangjiang New District.
