Provisions on letters and visits from public security organs

Chapter I General Provisions Article 1 These Provisions are formulated in accordance with the Regulations on Letters and Visits for the purpose of standardizing the work of letters and visits by public security organs, maintaining the order of letters and visits by public security organs, safeguarding the legitimate rights and interests of letters and visits, and keeping close contact between public security organs and the people. Article 2 Public security organs at all levels shall unblock the channels of letters and visits, listen to the opinions, suggestions and complaints of the people, accept their supervision, conscientiously do a good job in letters and visits, and strive to serve the people. Article 3 The petition work of public security organs shall adhere to the principles of territorial management, graded responsibility, whoever is in charge shall be responsible, timely solving problems on the spot and guiding education according to law. Article 4 Public security organs at all levels should make scientific and democratic decisions, perform their duties according to law, strictly enforce the law, enforce the law fairly and civilly, and strive to prevent and reduce the occurrence of letters and visits from the source.

Public security organs at all levels should establish a system of investigation and mediation of letters and visits, and solve the problems that may form letters and visits in the bud and initial stage in time. Article 5 Public security organs at all levels should strengthen their leadership over the work of letters and visits, establish a leading group for letters and visits composed of the heads of public security organs at the same level and the heads of relevant departments, give full play to the roles of various departments and police types, and form a pattern of letters and visits with unified leadership, departmental coordination, individual responsibility and joint management.

Public security organs at all levels shall provide protection for the work of petition agencies. Article 6 The persons in charge of public security organs at all levels shall read and approve letters, receive visitors, listen to reports on the work of letters and visits, and study and solve problems in the work of letters and visits. The public security organs at the prefecture and county levels must establish a reception day system for letters and visits by the public security bureau chief to directly handle letters and visits.

The person in charge of public security organs at all levels or their designated personnel may interview and communicate with the petitioner's residence on the outstanding problems reflected by the petitioner. Seventh public security organs at all levels shall establish a reporting and handling system for major letters and visits.

Major and urgent letters and visits and letters and visits information shall not be concealed, falsely reported or delayed, and shall not instruct others to conceal, falsely report or delay.

The relevant public security organs shall, within the scope of their duties, take timely measures to prevent the occurrence and expansion of adverse effects on major and urgent letters and visits and information that may cause social impact. Eighth public security organs at all levels shall establish and improve the accountability system for letters and visits, and investigate the responsibilities of the relevant personnel in the work of letters and visits in accordance with relevant laws and regulations and these Provisions, and notify them. Article 9 Public security organs at all levels shall incorporate the performance of letters and visits into the evaluation system of leading bodies and leading cadres, the evaluation system of law enforcement quality and the evaluation system of the people's police.

The public security organ shall take whether the complaint reporting matters are solved in the public security organ at the same level or in the local area as an important basis for performance appraisal.

Units and individuals that have made remarkable achievements in the work of letters and visits shall be commended and rewarded. Article 10 The public security organ and its people's police shall protect the lawful rights and interests of the petitioners according to law, and shall accept the petitions put forward by the petitioners that fall within the jurisdiction of the public security organ at the corresponding level, and shall not prevaricate, perfunctory or delay; Do not discriminate, make things difficult and take revenge on the complainant; Shall not disclose the complainant's report or exposure materials or related information to the individual or unit that has been reported or exposed. Article 11 If the petition staff of the public security organ has a direct interest in the petitions or the petitioners, they should withdraw. Twelfth public security organs should make full use of the existing information network resources, and gradually establish a national public security petition information system, and gradually realize the interconnection with the people's government at the same level and the public security organs at lower levels. Chapter II Letters and Visits Institutions and Duties Article 13 Public security organs at the county level shall, in accordance with the principle of being conducive to work and letters and visits, set up special letters and visits institutions or determine institutions and full-time personnel responsible for letters and visits; Public security organs at or above the prefecture level shall set up special complaint reporting institutions.

The departments with heavy tasks in the petition work of public security organs shall determine the leaders and staff responsible for the petition work of their own departments. Fourteenth public security organs at all levels are the functional departments of public security organs at the same level responsible for letters and visits. Its main responsibilities are:

(1) Registering petitions and accepting petitions under the jurisdiction of public security organs at the corresponding level;

(2) handing over the accepted letters and visits to the relevant departments and police in accordance with the division of responsibilities, or handling them by themselves;

(3) Coordinating and handling important letters and visits;

(four) to undertake the letters and visits assigned by the higher authorities;

(five) to transfer or assign petitions to the public security organs at lower levels, and to review the completion reports submitted by them;

(six) a written reply to the handling of the complaint or inform the complainant;

(seven) to supervise, inspect and guide the petition work of other departments of public security organs at the same level and public security organs at lower levels;

(eight) in the work of letters and visits, it is found that the police have violated the law and discipline, and reflect and put forward suggestions to the relevant departments;

(nine) to study and analyze the situation of letters and visits, carry out investigation and study, and put forward suggestions on strengthening and improving public security work and the construction of public security team in a timely manner. Fifteenth departments of public security organs, police in accordance with the division of business, have the responsibility to undertake petitions within the scope of their functions and powers. The petitions transferred from the petition office shall be handled seriously and promptly, and the results shall be written back to the petition office within the prescribed time limit.

The problems reflected involve criminal and administrative law enforcement work, which shall be handled by the competent business department; Reflect the problems involved in law enforcement fault cases identified by the legal department; Reflect the problems involving units and police violations, handled by the Commission for Discipline Inspection, supervision, auditing and other departments; Reflect the problems involving multiple departments, led by the main person in charge of the public security organs at the same level, organize and coordinate the relevant departments to handle.
