The people's governments of cities and counties, the Agricultural Bureau of the autonomous region, the departments and institutions directly under the people's government of the autonomous region:

In order to implement the spirit of Notice of the General Office of the State Council on Properly Solving the Treatment of Retired Teachers in Primary and Secondary Schools Run by State-owned Enterprises (Guo Ban Fa No.20049) and Notice of the General Office of the People's Government of Guangxi Zhuang Autonomous Region on Implementing the Treatment of Retired Teachers in Primary and Secondary Schools Run by State-owned Enterprises Directly under the Autonomous Region (Zheng Gui Ban Fa No.200697) and properly solve the treatment of retired teachers in primary and secondary schools run by state-owned enterprises directly under the autonomous region (hereinafter referred to as state-owned enterprises), with the consent of the people's government of the autonomous region, relevant issues are hereby notified as follows.

First, the scope of the transfer of primary and secondary schools run by state-owned enterprises to local government management.

According to the Teachers Law, the primary and secondary schools run by state-owned enterprises mentioned in this supplementary notice refer to kindergartens, special education institutions, ordinary primary and secondary schools, adult primary and secondary education institutions, vocational middle schools and other educational institutions run by state-owned enterprises. Retired teachers in primary and secondary schools run by state-owned enterprises refer to full-time teachers, managers and teaching assistants who go through retirement (resignation) procedures in primary and secondary schools run by state-owned enterprises in accordance with the provisions of the state and autonomous regions. Full-time teachers, managers and teaching assistants among the full-time employees of state-owned enterprises refer to those who have retired from primary and secondary schools run by state-owned enterprises with the approval of enterprises because of downsizing and increasing efficiency. State-owned enterprises that retire after the implementation of teacher post evaluation and appointment in their schools should have the conditions for evaluating and appointing primary and secondary school teachers; Retired state-owned enterprises that run primary and secondary schools after implementing the teacher qualification certificate management system according to regulations also need to have primary and secondary school teacher qualification certificates.

Two, the state-owned enterprises run primary and secondary school retired teachers' identity, treatment standard identification procedures.

(1) The enterprise carefully investigates and verifies the personnel files of retired teachers, makes statistics and records, and reports them to the competent department of the enterprise (if the competent department of the enterprise has been revoked, it shall be reported to the unit that inherited the functions of the original competent department) for preliminary examination, and it shall be audited and determined according to the education administrative department and personnel (human resources and social security) department of the people's government of the prefecture-level city where the enterprise is located.

(two) the enterprise will be approved by the administrative department of education and personnel (human resources and social security) department of retired teachers list in the bulletin board of the unit publicity for 7 working days. If there is no objection at the expiration of the publicity period, the personnel files of retired teachers will be carried, and the personnel (human resources and social security) department of the people's government where the enterprise is located will verify its retirement benefits according to the retirement benefits standards actually implemented by similar retired teachers in the local government.

(III) The enterprise shall register the recognized retired primary and secondary school teachers and report to the social security agency of the insured place for examination and determination of their basic pension standards, and then calculate the difference between the monthly basic pension of retired teachers and the standards that retired primary and secondary school teachers run by local governments should enjoy one by one, and transfer them to local governments after statistics, so as to calculate the transfer costs.

(four) before the closure and bankruptcy of state-owned enterprises, the calculation of the statistical expenses of retired teachers in primary and secondary schools and the application for financial subsidies shall be undertaken by the enterprises' left-behind offices; If there is no left-behind workplace, the original competent department shall be responsible for it; If the original competent department has been revoked, the unit that inherits the functions of the original competent department shall be responsible, and the statistics, cost accounting and financial subsidy application of retired teachers in primary and secondary schools before the restructuring and reorganization shall be responsible for the restructuring of state-owned enterprises; If the enterprise after the restructuring is a non-state-owned enterprise, the competent department of the enterprise before the restructuring shall be responsible. If the original competent department has been revoked, it shall be the responsibility of the functional unit that inherits the original competent department (hereinafter, the units responsible for handling related affairs shall be collectively referred to as "enterprise representative units").

The retirement of primary and secondary school teachers run by state-owned enterprises shall be handled according to the above procedures after reaching the legal retirement age and officially going through retirement procedures.

Three, retired teachers handed over to the local government management measures

(1) Standardize handover procedures.

In order to straighten out the management relationship of retired teachers in primary and secondary schools run by state-owned enterprises and ensure that the retirement benefits of retired teachers are paid in full and on time, all retired teachers in primary and secondary schools run by state-owned enterprises that meet the scope specified in Article 1 of the Supplementary Provisions shall be handed over to the local government for enterprise management according to the principle of territoriality. Before June 65438+1 October12004, the primary and secondary schools run by state-owned enterprises have been handed over to the local government for management, but the retired teachers have not been handed over, and the procedures for the transfer of retired teachers shall be handled according to the provisions of this supplementary notice.

(2) Reply on the allocation of funds

1. The funds required for the transfer of retired teachers from primary and secondary schools run by state-owned enterprises to local government management shall be allocated to the people's government of the receiving place in one lump sum according to the actual difference between the basic pension for retired teachers at the time of transfer and the retirement fee for retired teachers from similar primary and secondary schools run by the people's government of the place where the enterprise is located 10 year, and shall be distributed by the relevant departments of the people's government of the receiving place.

3. Enterprises directly under the autonomous region have been restructured into non-state-owned enterprises, and retired teachers who have gone through the retirement formalities in accordance with the policies and regulations of the state and the autonomous region have transferred funds before the restructuring, and after the restructuring, they have not retained assets or expenses that cannot be solved through other channels, which shall be solved by the financial arrangements of the autonomous region at the corresponding level.

4. The state-owned enterprises directly under the autonomous region that have been closed down shall be solved by the financial arrangement of the autonomous region at the same level.

Four, the relationship between retired teachers' pension insurance.

When the retired teachers who have participated in the basic old-age insurance for enterprise employees and paid by social insurance agencies are handed over to the local government for management, the social insurance agencies in the place where the pension insurance relationship for retired teachers is located will allocate all the fund balance of the personal account of the basic old-age insurance for retired teachers to the people's government in the receiving place, and terminate the basic old-age insurance relationship between retired teachers and enterprise employees, and the social insurance agencies will no longer be responsible for the payment of basic old-age insurance benefits for retired teachers. If the fund balance in the personal account of the basic old-age insurance for retired teachers is insufficient, the total basic pension of 10 years calculated based on the basic pension that retired teachers should receive in the current month at the time of transfer shall be made up by the social insurance agency of the unit where they work from the basic old-age insurance fund for enterprise employees, and the people's government of the receiving place shall pay the retirement benefits for retired teachers.

After the retired teachers are handed over to the local government for management, the retirement benefits of the retired teachers shall be paid by the people's government of the receiving place with reference to the retirement benefits standards of similar primary and secondary school retired teachers organized by the local people's government.

V. Procedures for transferring retired teachers to the local government for management

(a) the enterprise (or enterprise representative unit) shall, in accordance with the provisions of this supplementary notice, do a good job in the management of the transfer of retired teachers to the local people's government.

(two) the people's government (or authorized institution) where the enterprise is located and the enterprise (or enterprise representative unit) signed an agreement on the management of the transfer of retired teachers.

(3) The enterprise will transfer the transfer funds to the local government in time as agreed by both parties, and send the signed transfer management agreement (copy) to the competent department of the enterprise, the Education Department of the autonomous region, the Human Resources and Social Security Department of the autonomous region and the Finance Department of the autonomous region for the record.

(four) social insurance agencies in accordance with the provisions of timely disbursement of fees to the local government.

(5) If a state-owned enterprise or bankrupt enterprise directly under the autonomous region that needs financial subsidies at the autonomous region level closes down, the enterprise shall send the application materials of the transfer agreement and financial subsidies at the autonomous region level to its competent department for examination and approval. The audit opinions issued by the competent department of the enterprise shall be sent to the Finance Department of the autonomous region. In line with the conditions of subsidies for enterprises in difficulty, the Finance Department of the autonomous region will distribute (or allocate) the subsidy funds to the people's government (or enterprise) where the enterprise is located.

Six, clear responsibilities of various departments

(1) Responsibility of the department in charge of the enterprise (or the unit that inherits the responsibilities of the department in charge): Organize and urge the competent enterprise to do a good job in solving the treatment of retired teachers in primary and secondary schools run by state-owned enterprises in accordance with the provisions of document No.200697 issued by Zheng Gui and this supplementary notice, and assist the education department in the identification of primary and secondary schools run by state-owned enterprises.

(two) the responsibilities of the administrative department of education: responsible for the identification of the transfer of state-owned enterprises to local governments to run primary and secondary schools; Identify retired teachers in primary and secondary schools run by state-owned enterprises that meet the conditions for transfer, and affix their seals for approval.

(3) Responsibilities of human resources and social security departments: identify the status of retired teachers in state-owned primary and secondary schools that need to be handed over to local governments for management, and verify the retirement benefits of those who have been identified as retired teachers according to the standards of similar retired teachers run by local governments, and affix seals to confirm; If the transfer agreement has been signed, the one-time transfer fee shall be paid to the people's government of the receiving place in time according to the regulations; After the retired teachers are handed over to the local government for management, they will be responsible for adjusting the pension policy for retirees in public institutions if the state and autonomous regions have introduced it.

(4) Responsibilities of the financial department: To review the qualifications of enterprises in difficulty or the expenses related to the closure of bankrupt enterprises in conjunction with the competent departments of enterprises (or units that have inherited the responsibilities of the original competent departments), and timely allocate financial subsidy funds to specific distribution units.

(five) in addition to the above departments stipulated in this supplementary notice, other departments involved in the transfer of primary and secondary schools run by state-owned enterprises to local government management should actively cooperate and do a good job in the transfer of retired teachers.

Seven. job requirement

(a) the relevant departments should proceed from reality, do a good job in the implementation of the treatment of retired teachers in primary and secondary schools run by state-owned enterprises in accordance with the division of functions, and further coordinate and guide the work of local counterparts and enterprises, and urge this work to be completed on time and with good quality.

(2) All enterprises should do a good job in solving the problem of the treatment of retired teachers in primary and secondary schools as soon as possible, and actively communicate with relevant departments at all levels to do this work well.

(3) All localities, departments and enterprises should conscientiously do a good job in maintaining the stability of other retirees' letters and visits while implementing the spirit of the State Council Document No.20049, Gui Zhengfa Document No.200697 and this supplementary notice.

Eight. any other business

(a) the fees of retired teachers who have been transferred to the local government for management with the school shall be implemented according to the transfer agreement, and the amount of subsidies shall not be adjusted.

(2) After the retired teachers are handed over to the local government for management, their retirement benefits will be uniformly distributed according to the standards of similar retired teachers in primary and secondary schools run by the local government, and the relevant expenses for the adjustment of retirement teachers' benefits in the future will be solved by the local government.

(3) If the original provisions are inconsistent with this supplementary notice, the provisions of this supplementary notice shall prevail.

(four) this supplementary notice shall be implemented as of the month of promulgation.
