Regulations of Luoyang Municipality on Water Conservation

Chapter I General Provisions Article 1 In order to strengthen the management of water conservation, effectively protect and rationally utilize water resources, and build a water-saving society, these Regulations are formulated in accordance with the provisions of the Water Law of People's Republic of China (PRC), the Regulations on the Management of Water Conservation in Henan Province, and the actual situation of this Municipality. Article 2 These Regulations shall apply to water conservation and its management activities within the administrative area of this Municipality. Article 3 Water conservation shall follow the principles of planned water use, scientific development, recycling and benefiting people's livelihood, and implement the system of combining total control with quota management. Article 4 Water conservation shall be incorporated into the long-term and annual plans for national economic and social development.

People's governments at all levels and relevant departments should strengthen their leadership in water-saving work, extensively carry out water-saving publicity and education, improve the socialized service system for water-saving, popularize new technologies and processes for water-saving, promote the construction of reclaimed water and rainwater utilization facilities, develop water-saving industries, agriculture and services, and build water-saving units, water-saving communities, water-saving families and water-saving irrigation areas. Fifth city and county (city) water administrative departments in charge of water conservation work within their respective administrative areas.

City, county (city) water conservation management agencies specifically responsible for the daily management and supervision of water conservation within their respective administrative areas.

Development and reform, planning, finance, land and resources, housing and urban and rural construction, public utilities, quality and technical supervision, agriculture, forestry, gardens and other relevant departments shall do a good job in water conservation within their respective functions and duties. Article 6 All units and individuals have the obligation to save water, and have the right to supervise, stop and report acts of wasting water resources. Article 7 The news media shall carry out public welfare publicity on water conservation, publicize water conservation laws and regulations through various channels, popularize water conservation knowledge, and enhance the awareness of the whole people on water conservation. Eighth city and county (city) people's governments shall formulate incentive measures to commend and reward units and individuals that have made remarkable achievements in the research, popularization and application of water conservation and water conservation science and technology. Chapter II Planned Water Use Article 9 The water administrative department of a city or county (city) shall, jointly with relevant departments, formulate a water-saving plan in its administrative region according to the overall plan for economic and social development and the long-term plan for water supply and demand, and implement it after being submitted to the people's government at the same level for approval. Article 10 The municipal and county (city) development and reform administrative department shall, jointly with the water administrative department, formulate the annual total water consumption plan of the local area according to the water-saving plan, water quota, economic and technical conditions, public water supply situation and water distribution plan.

The water quota shall be subject to the local standards of Henan Province issued by the Henan Provincial Bureau of Quality and Technical Supervision.

Effectively protect scarce water resources such as geothermal water and mineral water, control exploitation in accordance with the total resources and relevant government regulations, take water strictly according to the plan, and prohibit unauthorized exploitation. Eleventh the following units and individuals to implement planned water management:

(a) into the water permit management and use of self-built water supply facilities;

Article 13 City and county (city) water-saving management institutions shall, according to the city's annual total water consumption plan, water consumption quota and corresponding industrial policies, refer to the water balance test results of planned users, rational water consumption level, water consumption in recent years and development demand, and report to the water administrative department for the record.

The water conservation management institution shall, before this year1February 3 1, issue the water use plan targets for the next year to the planned water users.

The planned water use unit shall, according to the annual water use plan index, decompose the planned water consumption monthly and according to the nature of water use, and report it to the water conservation management institution for the record. Fourteenth water planning units need to increase the water planning indicators, it shall apply to the water conservation management agencies. Water conservation management institutions shall, within ten working days from the date of receiving the application, approve and issue it. If it is not approved within the time limit, it shall be deemed as agreeing to adjust the water use plan indicators.

When the planned water consumption per unit with large water consumption may exceed the planned water consumption index, the water-saving management institution shall give prompt in time. Fifteenth planned water units of water projects, scale changes, water conservation management agencies can adjust their water planning indicators according to the actual water use of planned water units.

If the planned water users reduce the actual water consumption by adjusting the product and industrial structure, transforming the technology, building water-saving facilities and rainwater utilization facilities, the water-saving management institution shall not subtract the planned water consumption index for the next year. Sixteenth water conservation management agencies should be the annual water plan indicators and their adjustments to the public, accept social supervision. Seventeenth water units to build, rebuild, expand construction projects, the need for temporary water, it should be to the construction project planning permit and related procedures to apply for temporary water use planning indicators to the water conservation management agencies. Water conservation management institutions shall handle it within ten days.
