Does electronic resignation notice count as written resignation notice?

Legal analysis: not counting. Electronic resignation application is not a written resignation document, which does not meet the requirements and has no legal effect. Written form refers to contracts, letters and data messages (including telegrams, telexes, faxes, electronic data interchange and e-mails) and other forms that can tangibly express the content. Electronic data refers to information formed or stored in electronic media by means of e-mail, electronic data exchange, online chat records, blogs, Weibo, SMS, electronic signature and domain name. Therefore, employees' resignation by email or SMS is in writing.

Legal basis: Article 37 of the Labor Contract Law of People's Republic of China (PRC), the employee may terminate the labor contract by giving a written notice to the employer 30 days in advance. The employee may terminate the labor contract by notifying the employer three days in advance during the probation period.
