Overview of National Defense Mobilization Law

Article 72 of Chapter 14 of the National Defense Mobilization Law clearly stipulates the organization and leadership of national defense mobilization and its powers, the reserve and recruitment of reserve personnel, the reserve and deployment of strategic materials, and the guarantee of military scientific research, production and maintenance.

According to the National Defense Mobilization Law, the State Council and the Central Military Commission jointly lead the national defense mobilization work, formulate guidelines, policies and regulations for the national defense mobilization work, propose to the NPC Standing Committee to carry out national general mobilization or partial mobilization, and organize and implement national defense mobilization according to the decision of the NPC Standing Committee and the mobilization order issued by the Chairman.

At the same time, the national defense mobilization law stipulates that the state implements the national defense mobilization plan, the national defense mobilization implementation plan and the national defense mobilization potential statistical investigation system. The people's governments at or above the county level shall incorporate the relevant contents of national defense mobilization into the national economic and social development plan. The relevant military departments shall incorporate the national defense mobilization implementation plan into the combat readiness plan.

The National Defense Mobilization Law also stipulates that according to the needs of national defense mobilization, construction projects and important products closely related to national defense should implement national defense requirements and have national defense functions.

"In the past, relying mainly on administrative means for national defense mobilization has been difficult to adapt to the new situation and requirements. It is urgent to establish a national defense mobilization system and mechanism that adapts to the country's economic and social development and changes, and scientifically standardize the responsibilities, rights and obligations of the government, citizens and organizations in national defense mobilization activities. " In April 2009, Liang Guanglie, State Councilor, member of the Central Military Commission and Minister of National Defense, explained the draft national defense mobilization law to the meeting of the Standing Committee when it was first submitted to the National People's Congress Standing Committee (NPCSC) for deliberation.

In order to adapt to economic and social development and ensure the healthy development of national defense mobilization, the National Defense Mobilization Law has made corresponding provisions.

In view of the characteristics of frequent personnel flow under the market economy and the requirements of rapid mobilization of local wars under the information conditions, the National Defense Mobilization Law stipulates that the state implements a reserve system for reserve personnel.

In order to do a good job in wartime rescue, ensure that social medical and health resources can be mobilized in wartime to provide a strong guarantee for eliminating the consequences of war disasters, the National Defense Mobilization Law stipulates that the state should establish a medical and health rescue system that combines peacetime and wartime.
