Yesterday, the Ministry of Housing and Urban-Rural Development announced the Regulations on Housing Leasing and Sales Management (Draft for Comment), and publicly solicited opinions from the public. This is China's first regulation specifically for housing leasing and sales.

The "exposure draft" proposes that if the housing lease contract does not stipulate the number and extent of rent adjustment, the lessor may not unilaterally increase the rent; If a natural person sublets a house to a certain scale, it shall go through industrial and commercial registration according to law; Third-party online trading platforms that provide housing rental and sales information release services should also be responsible for the authenticity of the information.

The second part of the "Draft for Comment" requires that the lessor should meet the standards of the number of people renting a single room and the per capita rental area. Kitchen, bathroom, balcony, underground storage room and other non-residential space shall not be rented for living. The lessee shall abide by the provisions of laws and regulations, reasonably use the leased house in accordance with the contract and property management requirements, and shall not change the house structure and indoor facilities and equipment without authorization, and shall not harm the legitimate rights and interests of others.

At present, in Beijing's rental market, there is a phenomenon that a small intermediary pretends to be a natural person who rents a house and then sublets the house as a "second landlord".

It is worth mentioning that Article 29 of the Draft for Comment also clarifies that third-party online trading platforms that provide housing leasing and sales information publishing services should be responsible for the authenticity of the information.

If the parties receive services through the third-party online trading platform and their legitimate rights and interests are damaged, they may claim compensation from the information publisher. If the third-party online trading platform cannot provide the real name, address and effective contact information of the information publisher, it may demand compensation from the third-party online trading platform provider.
