Working rules for dispatching discipline inspection team

Article 1 In order to strengthen and standardize the work of the agencies dispatched by the discipline inspection and supervision organs, these Rules are formulated in accordance with the Work Regulations of the Commission for Discipline Inspection of China and the Supervision Law of People's Republic of China (PRC).

Article 2 The work of accredited institutions should adhere to the guidance of Xi Jinping's Socialism with Chinese characteristics Thought in the new era, strengthen the "four consciousnesses", strengthen the "four self-confidences", achieve the "two safeguards", persist in self-revolution, dare to struggle, persist in seeking truth from facts, thoroughly implement the strategic policy of strictly administering the party in an all-round way, unswervingly promote the building of a clean and honest party style and the fight against corruption, establish and improve the system and mechanism of accredited supervision, and enhance the authority and stationing of accredited institutions.

Article 3 Under the centralized and unified leadership of the CPC Central Committee, the Central Commission for Discipline Inspection shall send discipline inspection and supervision institutions to the Party and state organs and other organizations at the central level, and local discipline inspection committees at all levels shall send discipline inspection and supervision institutions to the Party and state organs and other organizations at the corresponding level. The accredited institution is an integral part of the dispatched institution, and the relationship with the accredited unit is supervision and supervision.

The accredited institutions should strengthen political supervision, adhere to and strengthen the Party's leadership throughout all aspects of the work process, promote the accredited units to effectively achieve the "two maintenances", implement the Party's theory, line, principles and policies, and implement the decision-making arrangements of the CPC Central Committee.

Article 4 An authorized institution shall carry out its work in accordance with the following principles:

(a) adhere to the centralized and unified leadership of the CPC Central Committee and strengthen the supervision function of the organization from top to bottom;

(two) adhere to democratic centralism, collective research and decision on important issues;

(3) Insist on being good at supervision and improve the normalized supervision mechanism;

(four) adhere to the responsibilities, perform their duties according to the law;

(5) Adhere to overall supervision and coordination, and promote the comprehensive and strict implementation of the party's main responsibility and supervision responsibility;

(six) adhere to the unity of supervision and supervision, and consciously accept supervision from all sides.

Article 5 The accredited institutions shall continue to deepen the construction of their functions, methods and work styles, focus on the comprehensive and strict administration of the Party, the building of a clean and honest party style and the anti-corruption work, strengthen their supervisory duties, highlight their work priorities, innovate their ways of performing their duties, effectively use the "four forms", enhance the full coverage of accredited supervision, and promote the high-quality development of accredited supervision.

Chapter II Organization?

Article 6 the National Supervisory Commission (NSC), the Central Commission for Discipline Inspection (hereinafter referred to as the National Supervisory Commission (NSC)), sends discipline inspection teams and supervision teams to Party and state organs at the central level and financial enterprises under the central management. The supervisory committees of local discipline inspection commissions at all levels send discipline inspection and supervision teams to the party and state organs at the corresponding level and state-owned financial enterprises under their jurisdiction.

The National Supervisory Commission (NSC), the Central Commission for Discipline Inspection, and the supervisory committees of local disciplinary committees at all levels sent discipline inspection and supervision teams to state-owned enterprises, institutions of higher learning and other units according to regulations; Or stationed in a supervision organization according to law, stationed in an Ombudsman and set up an Ombudsman's office to work together with the party's discipline inspection agency in this unit.

For units with large system scale, many directly affiliated units and many supervision objects, the discipline inspection and supervision team can be stationed separately; Relevant units with high business relevance or need to coordinate their efforts to implement supervision can be stationed in the discipline inspection and supervision group.

Article 7 The principal responsible person of an accredited institution shall be a member of the party group (Party committee) of the accredited institution in accordance with the regulations, perform special supervision duties and not be in charge of the work of the accredited institution.

The main person in charge of the accredited institution shall regularly exchange posts and rotate posts.

Article 8 The leading body of a registered institution is the Organizing Committee. The organizing committee is composed of the director and deputy director of the registered institution. The meeting of the Organizing Committee will study and implement the decision-making arrangements of the CPC Central Committee, the work arrangements of the State Supervision Committee of the Central Commission for Discipline Inspection, and the work arrangements of the dispatched organs, study and discuss important issues and matters in the discipline inspection and supervision work within its jurisdiction, and discuss or decide on matters such as party discipline and political discipline according to its authority.

The accredited institutions shall improve the meeting system of the Organizing Committee meeting, the team leader's office meeting, and the special meeting, and improve the decision-making mechanism.

Article 9 The accredited institutions shall, in accordance with the principles of coordination and mutual restraint in letters and visits, supervision and inspection, examination and investigation, case supervision and management, and case trial, set up internal institutions or define the division of labor according to the actual situation.

Chapter III Leadership System?

Article 10 Party committees at all levels shall strengthen their leadership over the work of the institutions stationed by discipline inspection and supervision organs, improve the institutional setup, cadre management and work guarantee mechanism, listen to the report of the Commission for Discipline Inspection and Supervision on the stationed supervision work, and promote the stationed institutions to perform their duties.

Article 11 The resident units shall support and cooperate with the work of the accredited institutions, actively and timely report important information and problems, and provide relevant materials according to the needs of the accredited institutions, so as to create conditions and provide guarantee for the accredited institutions to carry out their work.

Article 12 The accredited institutions are under the direct leadership and unified management of the dispatched institutions, and are responsible for and supervised by the dispatched institutions.

The Standing Committee of the Commission for Discipline Inspection at all levels shall regularly listen to the report on stationed supervision. The leaders in charge of the dispatched institutions shall hold regular meetings of the principals of the dispatched institutions, and often study the work with the principals of the dispatched institutions.

Article 13 The relevant departments of an agency shall strengthen the guidance, contact, service and guarantee for the agency according to their duties.

The supervision and inspection department assists the leaders in charge to contact the daily work of the accredited institutions:

(a) to guide and urge the accredited institutions to perform their duties;

(two) to check the problems and matters reported by the accredited institutions;

(three) to supervise the important cases and matters assigned by the dispatched organs;

(four) to handle important matters to support and coordinate the accredited institutions;

(5) to inform the accredited institutions of general problems and conversation reminders, criticism and education, inspection orders, admonishing conversations, etc. The leading group of the stationed unit and its members, as well as other personnel managed by the superior party Committee of the stationed unit;

(six) contact to carry out other work.

Article 14 The relevant departments of an agency shall jointly carry out the following supervision work with the agency:

(a) to carry out special inspections to promote the resident units to implement the decision-making arrangements of the CPC Central Committee;

(two) to study the political ecology of the stationed units and carry out targeted supervision;

(three) to carry out special investigation and study, find and analyze the use of public power and resources for rent-seeking, illegal employment after leaving the company and other industrial and systematic risks of clean government, and put forward opinions and suggestions to the stationed units or urge them to carry out special governance;

(four) to support and cooperate with the patrol agencies of the party committees at the same level of the dispatched agencies to carry out their work and urge the rectification;

(five) to promote the stationed units to implement the recommendations of discipline inspection and supervision;

(six) other supervision work that needs to be carried out jointly.

Article 15 The supervision and inspection department and the examination and investigation department of the dispatched office may directly handle or organize and direct the handling of major and complicated cases within the jurisdiction of the dispatched office.

Article 16 The relevant departments of the dispatched offices shall guide and coordinate the dispatched offices to cooperate with the supervisory committee of the local commission for discipline inspection to carry out the following work:

(a) to carry out special inspections and special supervision, and promote the solution of outstanding problems in related systems and fields;

(2) Take measures such as supervision and inspection, inspection and investigation;

(III) To determine the jurisdiction through consultation for cases involving party member, cadres and the monitored objects who are suspected of violating discipline, violating duty or committing duty crimes, or the dispatched institutions shall report to the dispatched institutions to designate the relevant local discipline inspection commission and supervision bureau for jurisdiction;

(four) joint evaluation and investigation of party member, cadres and supervision objects suspected of violating discipline and law, duty crimes;

(five) other work that needs cooperation.

Seventeenth agencies related departments shall organize and guide agencies to cooperate in the following work:

(a) for common or related issues to carry out special supervision;

(two) to conduct joint review and investigation of major and complex cases;

(three) to cooperate with the trial, reconsideration and review of the case;

(4) Cross-checking or joint-checking the implementation of the important work deployed by the dispatched institutions;

(5) Joint research and training;

(six) other work that needs cooperation.

Article 18 The stationed institutions shall strengthen the professional guidance, supervision and inspection of the discipline inspection institutions established by the stationed units and the discipline inspection institutions of the directly affiliated units, urge and support them to play their functional roles, promote the construction of discipline inspection cadres, strengthen political education and professional training, and coordinate personnel to carry out supervision and discipline work.

Nineteenth discipline inspection and supervision team stationed in vertical management units should strengthen the business guidance, supervision and inspection of the discipline inspection institutions at the next lower level of the unit, coordinate the work of discipline inspection institutions at all levels of the unit, and promote the implementation of supervision responsibilities at all levels. The supervision and discipline work of the next-level discipline inspection institution is mainly based on the head of the discipline inspection and supervision team. Clue disposal and case investigation should be reported to the discipline inspection and supervision group at the same time as the party group (party Committee) at the same level.

The work of the agencies of units, state-owned enterprises and state-owned financial enterprises that implement dual leadership and are mainly led by higher-level units shall be carried out with reference to the provisions of the preceding paragraph.

Twentieth the Commission for Discipline Inspection and Supervision Bureau of the dispatched organs of the Commission for Discipline Inspection at all levels shall hear the cases examined and investigated by the dispatched institutions in accordance with the provisions, and report to the dispatched organs on a regular basis. Under the leadership of the dispatched institutions, establish and improve the case quality evaluation mechanism, and feedback the evaluation results to the dispatched institutions.

The Commission for Discipline Inspection and the Supervision Bureau shall strengthen communication and coordination with the accredited institutions, and coordinate and guide the disciplinary review work of the party and state organs at the corresponding level.

Twenty-first discipline inspection and supervision team stationed in state-owned assets supervision institutions, education administrative departments, etc. , according to the provisions to assist agencies to strengthen the guidance of state-owned enterprises, institutions of higher learning, forming a joint force of supervision.

The discipline inspection and supervision team stationed in the state-owned assets supervision institution shall strengthen the leadership over the supervision and discipline work of the discipline inspection institutions of state-owned enterprises stationed in the management leading group of the party group (party Committee) of the unit. The handling of clues and the investigation of cases by the discipline inspection institutions of state-owned enterprises should be reported to the discipline inspection and supervision team stationed at the same level.

Chapter IV Job Responsibilities?

Twenty-second accredited institutions shall perform their duties of supervision, discipline, accountability and supervision, investigation and disposal according to law.

Twenty-third accredited institutions should take supervision as their basic duties, and combine the actual situation of accredited units to focus on supervision and inspection of the following situations:

(1) Being loyal to the Party and practicing its nature and purpose;

(two) the implementation of the party's theory, line, principles and policies, the implementation of the Party Central Committee's decision-making and deployment, and the practice of "two maintenance";

(3) Implementing the main responsibility of building a clean and honest party style, and strengthening the building of a clean and honest party style and anti-corruption work;

(four) the implementation of democratic centralism, correctly perform their duties according to the law, honesty and self-discipline.

Twenty-fourth agencies should focus on the supervision of the following objects:

(a) the leading group of the resident unit and its members, especially the main person in charge;

(two) other personnel stationed in the management of the higher party committee of the unit;

(three) the leading group and its members managed by the party group (party Committee) of the unit;

(four) other personnel of the unit included in the key supervision object.

Twenty-fifth accredited institutions shall support and urge the party group (Party committee) of the accredited unit to implement the main responsibility of strictly administering the party in an all-round way, assist it to carry out internal inspections, and promote the accredited unit to deepen reform, improve the system, improve governance and risk prevention and control.

Article 26 The stationed institutions shall, in combination with the stationed supervision work, promote the party group (party committee) of the stationed units to comprehensively carry out the situation and task education of strictly administering the party, building a clean and honest party style and anti-corruption work, strengthen the education of law and discipline and warning, promote the construction of a clean and honest culture, educate and guide party member, cadres and supervised objects to exercise self-discipline, and build a solid ideological and moral defense line.

Twenty-seventh agencies to reflect the problems of the party organization and party member, cadres and monitoring objects, in accordance with the provisions of the acceptance and disposal.

Twenty-eighth accredited institutions can participate in the preliminary verification, examination and investigation of the clues of the leading bodies and their members of the accredited units and other personnel under the management of the higher-level party committees of the accredited units suspected of violating discipline, illegal duties and duty crimes.

Twenty-ninth accredited institutions are responsible for reviewing the following cases of suspected violation of party discipline by party organizations and party member:

(1) Party organizations directly led by the Party Group (Party Committee) of the stationed unit;

(two) to manage the members of the leading group of the party group (party Committee) of this unit;

(3) The personnel specified in Item 4 of Article 24 of these Rules.

When necessary, the accredited institutions can review other party organizations managed by the Party Group (Party Committee) of the accredited unit and party member's alleged violation of Party discipline.

According to the authorization of the dispatched institution, the dispatched institution shall investigate the cases of suspected duty violations and duty crimes of the monitored object of the dispatched unit according to law.

Thirtieth accredited institutions shall, in accordance with the management authority, deal with and punish the violations of laws and regulations of the Party organizations, party member, cadres and supervisory objects in the accredited units, and shall be held accountable for the failure or improper performance of duties by the Party organizations and leading cadres in the accredited units.

Article 31 An authorized institution shall be responsible for accepting and handling the following appeals or applications for review:

(a) the party organization and party member's appeal to the decision made by the accredited institution;

(two) the application for review made by the object of supervision who refuses to accept the decision made by the accredited institution;

(three) the complaint of the respondent and his close relatives against the accredited institutions and their staff members for infringing upon the legitimate rights and interests of the respondent.

The resident institution shall assist the resident institution in handling the complaint or case review application filed by the resident institution after filing the case for review and investigation.

Chapter V Procedures for Performing Duties?

Thirty-second agencies to carry out daily supervision should go deep into the reality and the masses, supervision methods include:

(1) Attend the meeting. Participate in or attend important meetings such as the meeting of the leading group of the resident unit, understand and implement the decision-making arrangements of the CPC Central Committee and the decisions of the higher-level party organizations, as well as the opinions and attitudes of the team members, and the implementation of the "three majors and one big" decision-making system, and report to the dispatched organs in accordance with regulations.

(2) have a heart-to-heart talk. Have a heart-to-heart talk with party member, cadres and the masses, listen to the reflection of the object of supervision, find that there are signs and tendentiousness problems in the object of supervision, and make conversation reminders, criticism and education.

(3) Listen to the report. Listen to the report of the leading group and its members managed by the party group (Party Committee) of this unit, and remind them to correct if they find that their responsibilities are not in place.

(4) Obtain information. Consult and copy the relevant documents, materials, data and other materials of the resident units in accordance with the regulations, and understand and verify the relevant situation.

(5) communication. Strengthen communication with party committees, party committees' offices, personnel departments, patrol departments, legal affairs departments, financial audit departments, etc. , and find and report problems in time.

(6) analysis and judgment. Analyze the situation of letters and visits, party style and clean government, and put forward opinions and suggestions to the resident units on typical and universal issues.

(7) Integrity check. Establish and improve and dynamically update the archives of leading cadres managed by the party group (party Committee) of this unit, and strictly reply to the opinions of party style and clean government.

(8) Field investigation. Conduct on-site investigation and on-site verification to accurately find out the outstanding problems existing in the stationed units.

(nine) other ways to carry out daily supervision.

Thirty-third accredited institutions shall strictly implement the reporting system, and report to the dispatched institutions in a timely manner when discovering important problems and important matters of the leading bodies and members of the accredited units.

The accredited institutions should regularly analyze the situation that the leading bodies of the accredited units and their members adhere to the party's leadership, strengthen party building, fully fulfill the party's main responsibility, and build a clean and honest government, and submit special reports to the dispatched institutions every year.

Thirty-fourth accredited institutions shall, in conjunction with the party group (Party committee) of the accredited units, regularly study the comprehensive and strict administration of the party, the building of a clean and honest party style and the anti-corruption work. The supervision and inspection department of the dispatched office shall send personnel to participate according to the situation.

The main person in charge of the accredited institution should often communicate with the main person in charge of the party group (party Committee) of the accredited unit on political ecology, work style construction, and clean government risks. , put forward work suggestions, and urge the improvement of relevant system measures.

Thirty-fifth accredited institutions shall inform the members of the leading bodies of the accredited units of the compliance of the leading cadres of the competent departments and units with party constitution Party rules, honesty and self-discipline. Promote the members of the leading group to implement the requirements of "one post and two responsibilities" and do a good job in building a clean and honest government in the departments and units in charge.
