Article 1 In order to maintain financial order, prevent illegal fund-raising activities, and ensure social stability, these regulations are formulated in accordance with the relevant regulations on national financial management. Article 2 These regulations apply to all units and individuals within the administrative region of Dalian City. Article 3 Except for legal financial institutions, any unit or individual that raises funds for a fee in various forms is considered a fund-raising act. Article 4 Fund-raising activities within the administrative region of Dalian City shall be in charge of the authorized departments of the municipal government.

The Municipal Planning Commission, industry and commerce, public security and other departments, as well as the Dalian Branch of the People's Bank of China, should assist the competent authorities in the management of fund-raising activities. Article 5 Fund-raising activities must be conducted in accordance with the law.

All enterprises and institutions that issue corporate bonds, organize internal employee fund-raising, issue stocks, lottery tickets, and conduct various other paid fund-raising activities must report to relevant state agencies and the municipal fund-raising department for approval in accordance with relevant regulations. before proceeding. Article 6 It is prohibited for any unit or individual to conduct illegal fund-raising activities. Anyone who has any of the following circumstances is considered illegal fund-raising:

(1) Issuing bonds, stocks, lottery tickets and conducting various paid fund-raising without the approval of the national competent authority and the municipal fund-raising activity department ;

(2) To expand the scope of issuance, increase the issuance amount, increase the issuance interest rate, extend the return period and change the purpose of fund-raising without the consent of the national competent authority and the municipal fund-raising activity department;

(3) Individuals carrying out fund-raising activities;

(4) Other illegal fund-raising activities.

All units and individuals that illegally raise funds must bear financial and legal responsibility for their actions and the consequences of their actions. Article 7 For units and individuals that illegally raise funds, the competent departments for fund-raising activities and other relevant departments may impose fines, freeze funds raised, order refunds or suspend operations for rectification, depending on the severity of the case, and hold those responsible and the person in charge of the superior department accountable. . Article 8 For major cases of illegal fund-raising, the municipal department in charge of fund-raising activities shall report them to the Municipal People's Government to form a special agency to investigate and deal with them. Article 9 If the amount of illegal fund-raising is huge, the consequences are serious, and it constitutes a crime, it shall be handed over to the judicial organs for handling in accordance with the law. Article 10 For those who provide ticket printing, agency issuance or redemption, advertising and other services for illegal fund-raising, the municipal fund-raising department and other relevant departments shall hold them jointly and severally responsible, and impose penalties such as fines, suspension of business for rectification, etc. Article 11 If a unit uses public funds to participate in illegal fund-raising, all the funds shall be confiscated and turned over to the municipal finance, and the relevant personnel shall be held accountable. Article 12 Anyone who participates in illegal fund-raising activities will have their interests not protected by law and will bear the consequences at their own risk. If it causes harm to the country's financial order and social stability, the judicial organs have the right to pursue legal responsibility. Article 13 Anyone who incites trouble and undermines social security on the grounds of suffering losses due to illegal fund-raising shall be handed over to the public security organs for handling according to law. Article 14 For illegal fund-raising units and individuals that suffer serious losses, are insolvent and are unsustainable, the municipal government or the district, city, county government or relevant departments authorized by the municipal government may organize special agencies to liquidate them. Article 15 If the municipal department in charge of fund-raising activities violates relevant regulations and approves unqualified units to carry out fund-raising activities without authorization, the legal responsibility of their leaders shall be investigated in accordance with the law. Article 16 Illegal fund-raising activities that have been carried out before the promulgation of these regulations must be stopped and the funds raised must be refunded within the time limit. If serious consequences are caused, the municipal fund-raising department and other relevant departments shall investigate their economic and legal responsibilities in accordance with the law. Article 17 The administrative department for fund-raising activities in Dalian City is responsible for the interpretation of these regulations. Article 18 These regulations shall come into effect from the date of promulgation.
