Is Shanghai the first to introduce regulations to manage single-use prepaid cards?

In order to protect consumers' rights and interests, on July 27th, 20th 1 8th, the Regulations of Shanghai Municipality on the Management of Single-use Prepaid Consumer Cards was promulgated, and will be implemented on June 5438+1October1next year. The "Regulations" require that operators should give a notice 30 days in advance and notify registered card consumers by telephone, SMS or email if they affect the payment of single-use cards due to reasons such as suspension of business, closure of business or relocation of business premises. Consumers have the right to continue to perform or return the balance of advance payment according to the requirements of articles of association or contract.

Shanghai will also establish a list of serious untrustworthy subjects, which will include single-use prepaid consumer card operators who have closed their doors and run away, suffered more than two administrative penalties for violations within one year, illegally absorbed public deposits, and raised funds for fraud. In addition to the relevant provisions of local establishment, the relevant laws have long stipulated the behavior of defrauding advance payment in the name of operating a gym.

Zhang Shouyao, a lawyer of Sichuan Youtong Law Firm, said that the closure of the gym due to poor management is a general economic dispute. If it is a shot to change a place, the purpose of opening a gym is obviously not normal operation, but contract fraud. After the incident, consumers should call the police as soon as possible, and judicial organs should investigate their criminal responsibility according to law to protect consumers' rights and interests.
