How to declare submission for arbitration

Arbitration can be served by public announcement. The service of announcement only applies to the case that the whereabouts of the addressee are unknown and cannot be served by other means. The publicity period is 60 days, and the expiration of publicity is deemed as delivery. If the addressee has no domicile in People's Republic of China (PRC), the notice period is three months.

Article 92 of the Civil Procedure Law of People's Republic of China (PRC) * * * If the whereabouts of the addressee are unknown, or the addressee cannot be served by other means specified in this section, the service shall be announced. Sixty days after the announcement, it shall be deemed to have been delivered. When the announcement is served, the reasons and process shall be recorded in the file. Article 267 The people's court may serve the litigation documents on the parties who have no domicile in People's Republic of China (PRC) in the following ways: (1) Serve them in the manner stipulated in the international treaties concluded between the country where the addressee is located and People's Republic of China (PRC) or to which * * * participates; (eight) if it cannot be served in the above way, it shall be deemed to have been served three months after the date of announcement.
