Regulations of Wuhan Municipality on Drug Administration

Article 1 In order to severely punish criminal activities such as smuggling, trafficking, transporting, manufacturing drugs and illegally planting drug plants, it is strictly forbidden to take or inject drugs illegally, protect citizens' physical and mental health, maintain social order and ensure the smooth progress of socialist construction, according to the Criminal Law of People's Republic of China (PRC) (hereinafter referred to as the Criminal Law) and the Decision of the NPC Standing Committee on Drug Control (hereinafter referred to as the Decision on Drug Control). Article 2 The term "drugs" as mentioned in these Regulations refers to opium, heroin, methamphetamine (ice), morphine, marijuana, cocaine and other narcotic drugs and psychotropic substances that can make people addicted as stipulated by the state. Article 3 These Regulations shall apply to the drug control work within the administrative area of this Municipality. Article 4 Anti-drug work shall combine specialized organs with the masses, investigation with prevention, punishment with education. Article 5 People's governments at all levels shall lead and coordinate the drug control work within their respective jurisdictions. The public security organ is the administrative department in charge of drug control. Article 6 Public security organs, procuratorial organs, judicial organs and judicial administrative departments shall conscientiously perform their respective statutory duties and severely punish drug crimes according to law.

Health, medicine, industry and commerce, civil affairs, civil aviation, railways, transportation, postal services, customs and other relevant departments should do a good job in drug management according to their respective responsibilities.

State organs, enterprises and institutions, residents' committees and villagers' committees all have the responsibility to carry out drug control work in their own units and regions. Article 7 The funds needed for drug control work shall be included in the financial budget by the people's governments at all levels and used for special purposes. Article 8 Any of the following acts shall be investigated for criminal responsibility by judicial organs in accordance with the provisions of the Criminal Law:

(1) Smuggling, selling, transporting or manufacturing drugs;

(2) Illegally holding more than 200 grams of opium, more than 10 grams of heroin or methamphetamine, or a large quantity of other drugs;

(3) harboring criminals who smuggle, sell, transport or manufacture drugs, or harboring, transferring or concealing drugs or property obtained from crimes for criminals;

(4) illegally transporting or carrying acetic anhydride, ethyl ether, chloroform and other raw materials or preparations used in the manufacture of drugs into or out of the country, or illegally buying or selling the above-mentioned articles in China;

(5) Illegally planting more than 500 opium poppy plants or a large number of other original drug plants, or illegally planting opium poppy, marijuana and other original drug plants, and planting them after being dealt with by public security organs or resisting eradication,

(6) illegally buying, selling, transporting, carrying or holding a large number of seeds or seedlings of original plants of drugs such as opium poppy that have not been inactivated;

(seven) forcing, luring, abetting or deceiving others to take or inject drugs;

(eight) allowing others to take or inject drugs;

(9) Persons who produce, transport, market and use narcotic drugs and psychotropic drugs under state control according to law, in violation of state regulations, provide narcotic drugs under state control and psychotropic drugs that can make people addicted to drugs to criminals who smuggle and sell drugs or people who take or inject drugs. Article 9 Whoever illegally possesses less than 200 grams of opium, less than 10 grams of heroin or methamphetamine or other small amount of drugs, or illegally cultivates less than 500 original plants of opium poppy or other small amount of drugs, shall be punished by the public security organs in accordance with the provisions of the drug control decision. Article 10 Whoever illegally buys, sells, transports, carries or holds a small amount of seeds or seedlings of original plants of drugs, such as opium poppy, etc., shall have his illegal income confiscated by the public security organ and be fined not less than 3,000 yuan but not more than 10,000 yuan. Article 11 Anyone who illegally transports, buys, sells, stores or uses poppy shells shall be confiscated by the public security organ in accordance with the Regulations of the People's Republic of China on Administrative Penalties for Public Security, detained for less than 15 days, and may also be fined less than 3,000 yuan.

Anyone who adulterates poppy shells and poppy seeds in food produced or sold shall be punished in accordance with the provisions of the preceding paragraph, and the illegal income shall be confiscated by the public security organ. If the circumstances are serious, it shall be ordered to stop production and business. Twelfth hotels, entertainment, catering services, transportation and other units and housing tenants, should strengthen the management of their own units or places as one of the management responsibilities. Those who fail to report to the public security organs and take measures to stop the illegal and criminal activities of drugs in their own units or places shall be fined not less than 10,000 yuan but not more than 100,000 yuan by the public security organs, and fined not more than 1,000 yuan to the person in charge and the person directly responsible. If the circumstances are serious, it shall be ordered to make rectification within a time limit or suspend business for rectification. Thirteenth pharmaceutical production and sales departments and medical units shall strictly implement the "Measures for the Administration of Narcotic Drugs" and "Measures for the Administration of Psychotropic Drugs" of the State Council, and prohibit any unit or individual from illegally producing, trading and using narcotic drugs and psychotropic drugs under state control.

Violation of the provisions of the preceding paragraph shall be punished by the administrative department of health according to law. Article 14 the illegal gains from drugs and drug crimes, illegal gains and property used for crimes shall be confiscated.

The incomes from fines and confiscations shall be turned over to the treasury and used exclusively for drug control in accordance with state regulations, and no unit or individual may intercept, deduct or divide them among themselves.
