How to solve the problem after the credit card of China Everbright Bank is sued for overdue filing?

Legal analysis: repay the loan as soon as possible. If it is overdue to a certain extent, it will affect personal credit information and even cause criminal responsibility. If the credit card is overdue for three months or the bank fails to repay it twice, the bank will sue the party concerned. First of all, after repeated reminders from the bank, if the parties still fail to repay the money, the bank will file a civil lawsuit with the court. After the people's court hears the case, if the parties still fail to repay the loan, they can transfer the case to the public security organ for investigation and formally establish it as a criminal case. After investigation, the public security organ sent the case to the procuratorate for public prosecution, accusing the parties of bad behavior which constituted the crime of credit card fraud.

Legal basis: Article 196 of the Criminal Law of People's Republic of China (PRC) commits credit card fraud under any of the following circumstances. The term "malicious overdraft" as mentioned in the preceding paragraph refers to the behavior that the cardholder overdraws beyond the prescribed limit or time limit for the purpose of illegal possession, and refuses to return it after being urged by the issuing bank. Whoever steals a credit card and uses it shall be convicted and punished in accordance with the provisions of Article 264 of this Law.
