Is the short message form of accident confirmation valid?

At present, the traffic police mainly use the electronic accident liability certificate, which can be directly sent to the parties' mobile phones in the form of short messages through police affairs, thus avoiding the trouble of online inquiry. In daily accident handling, it is not only efficient, but also saves the owner's time and energy. The accident liability certificate issued by the traffic police does not need to be signed by both parties. The signature of the parties does not mean that the parties recognize the confirmation letter, but a way of delivery of the traffic police department.

The confirmation of road traffic accidents shall include the following contents:

1, the basic situation of parties, vehicles, roads and traffic environment in road traffic accidents;

2. A road traffic accident happened;

3. Road traffic accident evidence and accident cause analysis;

4, the fault and responsibility of the parties lead to road traffic accidents or accidents;

The name and date of the traffic administrative department of the public security organ that made the road traffic accident identification.

To sum up, the confirmation of road traffic accidents shall be signed or sealed by the police handling the case, stamped with the special seal for handling road traffic accidents by the traffic administrative department of the public security organ, and served on the parties respectively, and the parties shall be informed of the rights and time limit for applying to the traffic administrative department of the public security organ for review and mediation and bringing a civil lawsuit directly to the people's court.

The traffic administrative department of the public security organ shall, according to the on-site inspection, inspection, investigation and relevant inspection and appraisal conclusions of the traffic accident, make a traffic accident identification in time as evidence for handling the traffic accident. The traffic accident certificate shall state the basic facts, reasons and the responsibilities of the parties, and shall be served on the parties.

Article 74

In the event of a dispute in traffic accident compensation, the parties may request the traffic administrative department of the public security organ for mediation, or they may directly bring a civil lawsuit to the people's court.

After mediation by the traffic administrative department of the public security organ, if the parties fail to reach an agreement or fail to perform the mediation after it takes effect, the parties may bring a civil lawsuit to the people's court.
