What procedures and materials are needed for marriage registration?

The marriage registration process is roughly as follows:

(1) application

Those who meet the conditions for marriage registration shall go to the marriage registration office where one party's household registration is located with relevant documents, certificates and 3 registration photos. Both parties fill in the application documents for marriage registration on the spot.

The documents and materials for applying for marriage registration depend on individual circumstances. For example, when China citizens apply for marriage registration in China, they need to hold their valid marriage examination certificate, ID card, household registration book, single spouse certificate and a signed statement that they are not related to each other. For the divorced parties, they also need to hold divorce documents.

Foreigners who apply for marriage in China (including China people, foreigners who come to China permanently or temporarily, and foreigners who settle in China) must hold their valid passports or other identification certificates, nationality certificates, valid residence permits for foreigners, and marriage status certificates issued by local notary offices certified by the Ministry of Foreign Affairs (or authorized agencies of the Ministry of Foreign Affairs) and China's embassies and consulates in that country.

(2) Review

The marriage registration office will examine the application of the parties to determine whether the submitted marriage application meets the requirements. If the application materials submitted are unclear, the marriage registration authority will ask the parties concerned and ask them to provide relevant materials when necessary.

(3) Registration and licensing

If the application submitted by the parties meets the conditions for marriage, the marriage registration authority shall register it and then issue a marriage certificate; For those who have experienced divorce, the marriage registration office will cancel their divorce certificates; The marriage registration authority shall, at the request of the parties concerned, issue a written statement explaining the reasons for not registering those who do not meet the conditions for marriage.

What procedures and documents do you need for divorce?

The divorce registration process is as follows:

(1) application

If both parties voluntarily divorce, they shall sign a divorce agreement in accordance with the provisions, jointly apply to the marriage registration authority with jurisdiction, and provide the following documents and supporting materials:

1. Marriage certificate issued by the Mainland Marriage Registry or Chinese embassies and consulates abroad;

2. Identity documents required for divorce registration, such as household registration book, ID card, Hong Kong, Macao and Taiwan pass, passport, etc. ;

3. An application for divorce registration filled in at the marriage registration office.

(2) Accept

The staff of the marriage registration office will conduct a preliminary examination of the application materials submitted by both husband and wife as required. After the documents and certification materials submitted by the parties have been verified in the first instance, a "Receipt for Accepting the Application for Divorce Registration" will be issued. If there are differences with the conditions for divorce registration, the marriage registration authority will not accept it, and the registrar may issue a notice of not accepting the application for divorce registration.

(3) cooling-off period

Within 30 days from the date when the marriage registration office receives the application for divorce registration and sends the receipt of divorce registration application to the parties concerned, any party who does not want to divorce can go to the marriage registration office that accepts the application for divorce registration with his valid identity certificate and the receipt of divorce registration application (if it is lost, a written explanation is required), withdraw the application for divorce registration, and fill out the application for divorce registration withdrawal in accordance with the relevant provisions of the application for divorce registration withdrawal. After verification by the marriage registration authority, a Confirmation Letter for Withdrawing the Application for Divorce Registration will be issued. Within 30 days after the expiration of the cooling-off period for divorce, if both parties fail to jointly apply to the marriage registration authority for a divorce certificate, the application for divorce registration shall be deemed to have been withdrawn.

(4) Review

Within 30 days after the expiration of the cooling-off period of divorce (the last day of the period is a holiday, so the first day after the holiday is the date of expiration of the period), both parties should bring relevant documents and materials, such as photos, marriage certificates, ID cards or passports, divorce agreements, etc. , to the marriage registration office, according to the provisions of the divorce certificate. The marriage registration authority shall carry out the implementation and examination according to the provisions of the "Marriage Registration Standards". Those who do not meet the conditions for divorce registration will not be handled. When necessary, the marriage registration authority may, at the request of the parties concerned, issue a notice not to register for divorce.

(5) Registration (certification)

The marriage registration authority shall, in accordance with the relevant provisions, register the parties concerned and issue a divorce certificate.
