In order to further strengthen the management of commercial housing sales, protect the buyers' right to know and choose, and maintain the order of the real estate market, according to the relevant provisions of the Measures for the Administration of Urban Commercial Housing Pre-sale, we hereby notify you as follows:

Strengthen the pre-sale management of commercial housing

For projects that have not obtained the pre-sale permit for commercial housing, real estate development enterprises shall not pre-sell commercial housing in violation of regulations, nor shall they charge fees by subscription, subscription and number selection. , such as deposit, subscription, intention, group purchase fee.

Implement the system of clearly marked price and account publicity.

Real estate development enterprises should set reasonable prices and make sales plans. After obtaining the pre-sale permit for real estate development projects, all the sales houses and prices must be publicized at one time. According to the requirements of the competent price department, the system of "one room, one price" is clearly marked and the fund supervision account is publicized.

Standardize the marketing behavior of commercial housing

Real estate development enterprises must implement online signing and filing of commercial housing sales contracts and supervision of pre-sale funds, and sales places should publicize relevant documents, contract demonstration texts and other materials according to laws and regulations. The introduction of urban public service facilities in the sales advertisements of development projects shall conform to the planning and construction conditions of relevant projects of government departments and shall not be misleading.

Real estate development enterprises should strengthen the management of sales sites and sales personnel (including agents), and must not publish false housing information, and must not use online soft texts, official WeChat accounts, WeChat, SMS and other forms to publish and spread false information speculating on the rise and fall of housing prices, disrupting market order. Before signing the Commercial Housing Sales Contract with the purchaser, the salesperson should guide the purchaser to understand the on-site publicity information, remind him of the matters needing attention in purchasing the house, and inform him of the related unfavorable factors.

Real estate development enterprises shall publicize the Seven Tips on Commercial Housing Transaction Risks (Annex) in a prominent position in all real estate sales places.

Standardize parking space trading behavior

Real estate development enterprises shall publicize the distribution position, quantity and area of parking spaces in the form of plane schematic diagram, and publicize the sale and rental (gift) scheme of parking spaces. Ordinary property parking spaces shall not be sold in the name of transferring the right to use parking spaces. Parking spaces within the scope of civil air defense projects shall be clearly marked as "the parking spaces within the scope of civil air defense projects cannot be registered for real estate". Parking spaces within the scope of civil air defense projects can only be rented but not sold, and it is indicated in the relevant agreement to protect the buyer's right to know.

Take the responsibility of the sales subject

When a real estate development enterprise cooperates with a real estate brokerage agency to sell commercial housing, it must sign a written entrustment contract to standardize the agency behavior, and the development enterprise shall bear the main responsibility for the illegal behavior of the brokerage agency in selling commercial housing.
