(3) Collection procedures

The general contracting enterprises, first-class professional contracting enterprises and foreign construction enterprises registered in this city with a level of above 2 (including level 2) shall be uniformly collected by Tianjin Construction Team Management Station; Three-level construction general contracting enterprises, two-level (including two-level) professional contracting enterprises and labor service enterprises registered in this Municipality shall be levied by the construction administrative departments of all districts and counties according to the place where the enterprises are registered;

2. Payment notice issued by the county-level construction administrative department or city management station to which the deposit account belongs;

3. The enterprise shall pay the deposit in full at the bank where the deposit account is located with the notice of payment;

Second, the start-up procedure of margin financing and securities lending.

(1) Start application

When the project is in arrears with the wages of migrant workers, if the construction enterprise has no objection to the fact of arrears but is unable to repay it, it shall apply for a start-up deposit to solve the problem of wage arrears of migrant workers. The specific procedures are as follows:

1. The defaulting enterprise applies for startup on the system, and fills in the Approval Form for Startup of Wage Margin for Migrant Workers in Tianjin (see Table 2). Labor and social security departments, district and county construction administrative departments and the municipal management station where the project is located confirm the fact of default and the start-up amount;

2, the deposit account belongs to the county-level construction administrative department or the municipal management station to "Tianjin migrant workers wage margin application start approval form" for examination and approval, to recover the enterprise's "migrant workers wage margin deposit certificate";

3, the deposit account belongs to the district, county construction administrative departments or city management station according to the start-up procedure to extract the corresponding amount of deposit to pay the wages of migrant workers;

4, where the project is located, the construction administrative department, the labor and social security department and the relevant provincial construction management office in Tianjin shall supervise the wage payment of migrant workers on the spot.

(2) Forced startup

When the project is in arrears with the wages of migrant workers, the responsible enterprise (construction enterprise) refuses to admit the fact of arrears with the wages of migrant workers, and adopts the method of compulsory start-up deposit to solve the problem of arrears with the wages of migrant workers. The specific procedures are as follows:

1. After the construction administrative departments and labor and social security departments in the districts and counties where the project is located investigate and determine the fact of default, fill out the Approval Form for Compulsory Starting of Wage Margin for Migrant Workers in Tianjin (Table 3);

2, the deposit account belongs to the county construction administrative department or the municipal management station after verification and approval, can be forced to withdraw the corresponding amount of deposit from the enterprise deposit account to pay the wages of migrant workers;

3, through the system will be the enterprise "migrant workers wage deposit certificate" abolished;

Third, make up the deposit.

Enterprises whose original deposit is lower than the prescribed standard due to the arrears of wages of migrant workers shall make up the difference within 90 days. After the difference is made up, the administrative department in charge of construction in the districts and counties to which the margin account belongs or the municipal management station will reissue the "Certificate of Wage Margin for Migrant Workers".

Four. Increase, decrease, exemption and refund of deposit

(1) Adjustment time

2009 was the first year of deposit collection. From 20 10, the increase or decrease or exemption of the deposit will be adjusted in April every year according to the wage arrears of migrant workers in the previous year and the relevant integrity.

2. Simple process

(1) The administrative department in charge of construction in the districts and counties where the project is located shall submit a summary of complaints and letters from enterprises due to wage arrears of migrant workers to the administrative department in charge of construction in the districts and counties where the margin account belongs and the municipal management station;

(2) The administrative department in charge of construction in the districts and counties to which the margin account belongs or the municipal management station shall reduce the margin for the enterprises that have not defaulted on the wages of migrant workers, and publish the list of enterprises that have been reduced through the system, and send a short message notice to the enterprises that have been reduced;

(three) the enterprise shall, within 30 days after receiving the notice in any way, go through the corresponding formalities at the district/county construction administrative department or the municipal management station to which the deposit account belongs.

(4) Free of deposit.

According to the "Notice on Establishing the Wage Guarantee System for Migrant Workers in Construction Enterprises", it is required to be exempted from "relief conditions".

1. The district/county construction administrative departments and municipal management stations to which the margin account belongs are exempted from paying the enterprise margin according to the list of excellent and honest construction enterprises in Tianjin in the previous year issued by Tianjin Construction Committee;

2. Since 2009, the wages of migrant workers have not been owed for three consecutive years or the deposit has been halved for two consecutive years. The county construction administrative department or municipal management station to which the margin account belongs is exempt from the enterprise margin;

3, the enterprise to the deposit account belongs to the county administrative department of construction or city management station for refund procedures, re issued "migrant workers wage deposit certificate".

4, during the relief period, enterprises in arrears of wages for migrant workers, should be filled according to the original margin standard.

(5) Refund of the deposit

1. Foreign construction enterprises entering Tianjin shall submit the Registration Form for the Delisting of Foreign Construction Enterprises, the delisting statement published in Tianjin Daily and other materials to the municipal management station to apply for refund of the deposit;

2, the city's construction general contracting enterprises with the cancellation of the construction qualification certificate to the deposit account belongs to the county construction administrative departments or municipal management station to apply for a refund of the deposit;

3, in line with the requirements, the deposit account belongs to the county-level construction administrative department or the municipal management station to complete the refund procedures within 5 working days, and at the same time recover the enterprise "migrant workers wage deposit certificate".

Five, migrant workers wage margin supervision

Through the margin management system, the municipal management station grasps the margin payment and start-up of enterprises in Tianjin and other places, and monitors the margin management of the construction administrative departments in various districts and counties. The construction administrative departments of all districts and counties shall promptly report the arrears of wages of migrant workers in the projects under their jurisdiction.

1. Enterprises can only participate in bidding with the deposit certificate of migrant workers' wages. As one of the conditions of pre-bidding, the bidding department inquires about the validity of the deposit certificate of migrant workers' wages through the Internet.
