What collection behaviors are illegal?

First, insult others

Physical conflicts caused by abusive behavior are common, so in the process of collection, both sides should try to be calm, control their emotions and be reasonable. Don't swear.

Many people still have the idea of paying back their debts. This is in our nature. Therefore, when others are unable to repay their debts, they may even commit the crime of illegal detention by restricting their personal freedom. The law protects citizens' legitimate property, but it is never allowed to protect it in an illegal way.

Third, physical conflict.

Generally, payment is made face to face. When you find that the other party has physical conflicts, try to avoid them. If there is no way to avoid it, take appropriate self-defense and hand it over to the police for follow-up treatment. It is illegal for collectors to use violence or customers to use violence without justifiable reasons.

4. Sell the customer's property and collect the customer's cash.

In the process of collection, whatever has certain economic value, whether it is the trailer or the customer's property, needs to be reported to the company, waiting for the implementation of the disposal plan negotiated by the customer. Property shall not be disposed of at will without the consent of the customer. Collecting cash from customers without recording it may lead to duty crimes. It is also forbidden to sell customers' property and collect customers' cash.

Customer information is private. Spreading customers' information through the internet and other means infringes on customers' privacy, which is not allowed.

According to Article 238 of the Criminal Law of People's Republic of China (PRC), anyone who illegally detains others or illegally deprives others of their personal freedom by other means shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention, public surveillance or deprivation of political rights. Those who are beaten or insulted shall be given a heavier punishment.

Whoever commits the crime mentioned in the preceding paragraph and causes serious injuries shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years; Whoever causes death shall be sentenced to fixed-term imprisonment of not less than ten years. Whoever uses violence to cause disability or death shall be convicted and punished in accordance with the provisions of Articles 234 and 232 of this Law.

Whoever illegally detains another person or detains another person in order to claim debts shall be punished in accordance with the provisions of the preceding two paragraphs.

Any functionary of a state organ who commits the crimes mentioned in the preceding three paragraphs by taking advantage of his power shall be given a heavier punishment in accordance with the provisions of the preceding three paragraphs.

Article 245 Whoever illegally searches another person's body or residence, or illegally invades another person's residence, shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention. Any judicial officer who abuses his power and commits the crime mentioned in the preceding paragraph shall be given a heavier punishment.

Article 246 Whoever publicly insults others by violence or other means or fabricates facts to slander others, if the circumstances are serious, shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention, public surveillance or deprivation of political rights. The crimes mentioned in the preceding paragraph shall be dealt with only if they are told, except those that seriously endanger social order and national interests.

According to the General Principles of the Civil Law of People's Republic of China (PRC) and Article 101 of the Civil Law of People's Republic of China (PRC), citizens and legal persons enjoy the right of reputation, and the personal dignity of citizens is protected by law.
