The right to privacy gives the obligee the right to control private life, including the right to prevent others from stealing personal privacy and the right to decide whether to disclose privacy and the scope of disclosure to others. The common types of privacy right include personal life freedom right, information secret right, personal communication secret right and personal privacy utilization right.

Scope of application:

1. The subject of privacy can only be citizens, that is, natural persons, excluding legal persons. The secret of a legal person generally belongs to public affairs, not the content of personal dignity;

2. The object of privacy right includes private information, private activities and private sphere;

3. The scope of protection of privacy is limited by public interests. The right to privacy can be derogated. If the public interest relative to the right to privacy is important enough, then the right to privacy can be derogated and restricted. However, this restriction should strictly abide by the principle of due process, that is, it is a powerful restriction and constraint on public power to interfere in private life, and relevant procedural rules should be followed in law enforcement and judicial procedures.

Article 120 of the Civil Procedure Law of People's Republic of China (PRC) stipulates that the infringement shall be stopped, the influence shall be eliminated, an apology shall be made, and the loss shall be compensated. Anyone who infringes upon the privacy of others and causes property losses shall be fully compensated according to the principle of full compensation. Anyone who infringes upon the privacy of others and causes mental damage to others, resulting in serious consequences, the victim has the right to request compensation for mental comfort.
