Statistical law enforcement inspection regulations

Chapter I General Provisions Article 1 These Provisions are formulated in accordance with the Statistics Law of the People's Republic of China and its detailed rules for implementation in order to scientifically and effectively organize statistical law enforcement inspections, ensure the implementation of statistical laws and systems, and maintain and improve the quality of statistical data. Article 2 Statistical administrative organs at all levels shall be responsible for implementing and supervising the implementation of statistical laws and statistical systems, and uniformly leading and organizing statistical law enforcement inspections within their respective administrative areas.

The relevant departments of the people's governments at or above the county level shall, under the organization and guidance of the statistical administrative organs at the same level, be responsible for supervising and inspecting the implementation of statistical laws and statistical systems within their own systems, and assisting the statistical administrative organs in investigating statistical violations within their own systems. Article 3 Statistical administrative organs at all levels shall establish a responsibility system for statistical law enforcement inspection, and effectively guarantee the personnel, funds and other working conditions required for statistical law enforcement inspection. Article 4 Statistical law enforcement inspection shall follow the principles of abiding by laws, strictly enforcing laws, and prosecuting offenders, adhere to the combination of prevention and investigation, punishment and education, and be conducted legally, fairly, openly and efficiently. Chapter II Statistical Inspection Institutions and Statistical Inspectors Article 5 The Legal Affairs Office of the National Bureau of Statistics is responsible for the unified organization and management of statistical law enforcement inspection throughout the country. The legal institutions of the statistical administrative organs of all provinces, autonomous regions and municipalities directly under the Central Government shall be responsible for the unified organization and management of statistical law enforcement inspection within their respective administrative areas. The statistical administrative organs at the prefecture and county levels shall set up statistical inspection institutions according to the needs of their work. If there is no inspection agency, the relevant agencies shall be designated to be responsible for the statistical law enforcement inspection within their respective administrative areas. Statistical administrative organs at all levels and their directly affiliated investigation teams and census centers may be equipped with statistical inspectors according to the needs of their work. The relevant departments of the people's governments at or above the county level may be equipped with statistical inspectors according to the needs of their work. Article 6 The main duties of statistical inspection institutions are:

(a) to publicize and implement the statistics law;

(two) to organize, guide, supervise and manage the statistical law enforcement inspection work within their respective administrative areas;

(three) investigate and deal with statistical illegal cases according to law;

(four) to handle the statistical administrative reconsideration and statistical administrative litigation matters of this organ;

(five) other duties entrusted by laws, regulations and rules. Article 7 A statistical inspector shall meet the following conditions:

(a) adhere to principles, decent style, loyal to their duties, law-abiding;

(2) Having a college degree or above;

(three) engaged in statistical work for more than two years and familiar with statistical business;

(four) to participate in the qualification training of statistical inspectors and obtain certificates. Article 8 The qualification training and assessment of statistical inspectors shall be uniformly planned, organized and managed by the National Bureau of Statistics, and the statistical administrative organs of provinces, autonomous regions and municipalities directly under the Central Government shall be responsible for the implementation. Ninth statistical administrative organs at all levels should strengthen the professional ethics education and vocational skills training for statistical inspectors within their respective administrative areas, and improve the management, assessment, reward and punishment system. Chapter III General Principles of Statistical Law Enforcement Inspection Article 10 Statistical administrative organs at all levels and relevant competent departments shall establish a regular inspection system for statistical law enforcement, and conduct regular inspections by means of comprehensive inspection, special inspection and key inspection. Eleventh statistical law enforcement inspection items include:

(a) whether statistical agencies and statisticians have violated the independent exercise of statistical investigations, statistical reports and statistical supervision;

(two) whether there is any violation of the statistical system and legal procedures to modify the statistical data;

(three) whether there is any act of false reporting, concealment, forgery, tampering, refusing to report or delaying the reporting of statistical data;

(four) whether to set up statistical agencies or statisticians according to law;

(five) whether to set up the original records and statistical accounts;

(six) whether the statisticians are certified and whether their transfer is in accordance with the relevant provisions;

(seven) whether the statistical investigation project is submitted for approval and filing according to legal procedures; Whether to indicate the legal symbol in the upper right corner of the statistical questionnaire;

(eight) whether to conduct the investigation in strict accordance with the approved investigation plan, and whether to change the content, object and time of the investigation at will;

(nine) whether the management and publication of statistical data comply with the relevant provisions, and whether there is any act of revealing state secrets, business secrets of statistical survey objects and individual survey data of private individuals and families;

(ten) whether it has the legal qualification to engage in foreign-related social investigation, whether it has been approved or put on record according to law, and whether it has marked a legal mark in a prominent position on the front page of the questionnaire;

(eleven) other matters stipulated by laws, regulations and rules. Twelfth statistical administrative organs at all levels shall formulate inspection plans before organizing the implementation of statistical law enforcement inspection. The inspection plan includes the basis, time, object, project and organization form of the inspection.

The same inspection organ shall not carry out statistical law enforcement inspection on units not suspected of violating the law more than once a year. Thirteenth the implementation of statistical law enforcement inspection, should inform the inspected object in advance, inform the inspection organ's name, inspection basis, scope, content, method and time, and specific requirements for the inspected unit.

To inspect the units suspected of statistical violations, an inspection notice may be issued when the inspection organ deems it appropriate. Fourteenth inspectors to carry out statistical law enforcement inspection, should first show the inspection object "statistical law enforcement inspection certificate" or other law enforcement certificates stipulated by laws and regulations. The relevant units and individuals have the right to refuse to accept the inspection if they fail to produce their legal law enforcement certificates. The statistical law enforcement inspection certificate shall be uniformly printed by the National Bureau of Statistics, and shall be issued and managed by the statistical administrative organs of provinces, autonomous regions and municipalities directly under the Central Government.
