Article 1 In order to strengthen the management of urban rail transit control protection zones and ensure the construction, operation safety and construction conditions of urban rail transit, these Measures are formulated in accordance with the Regulations of Urumqi Municipality on the Administration of Rail Transit and the actual situation of this Municipality. Article 2 These Measures shall apply to the delineation of urban rail transit control protection zones in this Municipality, as well as the management activities such as external operation and safety protection inspection in the protection zones. Article 3 The urban rail transit control protection zone as mentioned in these Measures (hereinafter referred to as the rail transit control protection zone) refers to a certain range demarcated along the rail transit to reasonably limit the construction and operation activities within this range in order to ensure the construction and operation safety and construction conditions of rail transit. Article 4 The municipal construction administrative department shall be responsible for the supervision and management of urban rail transit control protected areas, take the lead in setting up a working group of the joint office for the management of rail transit control protected areas composed of relevant administrative departments and the people's governments of districts (counties) along the rail transit line, coordinate and solve the problems in the management of rail transit control protected areas, and carry out and promote the management informatization of rail transit control protected areas. Article 5 The people's governments of districts (counties) along the rail transit shall do a good job in the territorial management of rail transit control protection zones in accordance with relevant regulations.

The municipal administrative department of urban and rural planning is responsible for bringing all kinds of rail transit planning into the scope of planning control that should be implemented, doing a good job in the control and management of land use, stations and depots along rail transit in accordance with the approved rail transit network planning and regulatory detailed planning, and the planned (reserved) land use shall not be changed without authorization.

The municipal administrative department in charge of urban management is responsible for the protection and management of the rail transit control protection zone, and is responsible for investigating and handling foreign operations in the rail transit control protection zone without obtaining the relevant administrative license according to law.

Municipal development and reform, finance, transportation, natural resources, ecological environment, public security, auditing and other departments shall, within the scope of their respective duties, assist in the supervision and management of rail transit control and protection areas. Article 6 Rail transit control and protection zones shall be set up along the rail transit, and special rail transit protection zones shall be set up within the control and protection zones of rail transit lines built and completed. The scope of controlling protected areas and special protected areas includes underground, surface and above ground.

Scope of the planned line control protection zone for rail transit:

(a) within 30 meters on both sides of the center line of the ground line, overhead line, underground line and transition line;

(2) Within 35 meters outside the station contour line (entrance and exit, wind pavilion);

Within 35 meters outside the underground air duct.

Scope of rail transit line control protection zones under construction and completion:

(a) within fifty meters of the outer line of the underground station and tunnel structure;

(2) Within 30m from the ground, the elevated station and the outside of the track structure;

(three) entrances, ventilation kiosks (wells), substations, vertical elevators and other buildings (structures) outside the line and the vehicle base, parking lot land outside the scope of ten meters;

(four) rail transit across the river (lake) tunnel, bridge structure line 100 meters.

The scope of the special protection area:

Within ten meters of the outer edge of underground stations and tunnels;

(2) The ground, elevated stations and track structures are within five meters of the lateral horizontal projection;

(three) entrances and exits, ventilation kiosks (wells), substations, vertical elevators and other buildings (structures) outside the line and the vehicle base, parking lot land outside the scope of five meters;

(four) rail transit across the river (Lake) tunnel, bridge structure outside the outer edge of the line within fifty meters.

In the special protected areas, no other construction activities are allowed except the necessary municipal, garden and landscape projects.

Encourage the joint construction of rail transit station entrances, wind pavilions and new buildings around the land. Due to geological conditions or other special circumstances, it is necessary to expand or adjust the scope of control protected areas and special protected areas, which shall be handled by the municipal construction administrative department in accordance with the prescribed procedures. Article 7 The municipal construction administrative department shall put forward the specific scope of control protection zones and special protection zones according to the planning and construction sequence of rail transit network, solicit the opinions of the administrative departments of urban and rural planning, transportation, natural resources, urban management and the people's governments of districts and counties along the line, report to the municipal people's government for approval and announce to the public. Article 8 After the specific scope of the rail transit control protection zone is approved and announced by the Municipal People's Government, the rail transit business unit shall complete the identification or sign setting of the rail transit control protection zone within 120 days.

If it is necessary to use or occupy the relevant land due to the setting of signs or signs of rail transit control protection areas, the land owner or user shall cooperate; Involving administrative examination and approval, the relevant administrative departments shall handle it according to law. Article 9 The rail transit business unit shall be responsible for the daily safety inspection of the rail transit control protection zone, and shall sign a safety agreement with the unit or individual that carries out external operation, and jointly formulate a safety protection plan with the external operation unit or individual, and evaluate the influence of external operation on the construction and operation safety of rail transit in the whole process. Tenth external operating units or individuals shall abide by the relevant provisions of the safe production and management of rail transit control protection zones, and take effective measures to ensure the safety of rail transit construction and operation.
