Regulations of Linfen Municipality on the Administration of Electric Bicycles

Article 2 These Regulations shall apply to the production, sale, maintenance, registration, traffic, parking, charging and related management activities of electric bicycles within the administrative area of this Municipality.

Article 3 The people's governments of cities and counties (cities, districts) shall strengthen their leadership over the management of electric bicycles, establish a work coordination mechanism, guarantee work funds, and urge relevant departments to perform their supervisory duties according to law.

the township (town) people's government and street offices shall urge the units under their jurisdiction to implement the traffic safety and fire safety responsibilities of electric bicycles.

villagers' committees and residents' committees shall assist in the relevant work. Fourth city and county (city, district) public security organs traffic management department is responsible for the registration of electric bicycles and road traffic management.

the market supervision and management department is responsible for the supervision and management of the production, sales and maintenance of electric bicycles and related products, and the supervision and management of compulsory product certification of electric bicycles.

the ecological environment department is responsible for the supervision and management of pollution prevention and control of waste batteries of electric bicycles.

the housing and urban-rural construction department is responsible for supervising and guiding the construction of electric bicycle parking places and charging facilities, and urging property service enterprises and management units to strengthen the parking and charging management of electric bicycles in the property service area.

the departments of industry and information technology, finance, planning and natural resources, education, urban management, transportation, fire fighting and rescue, etc. shall do a good job in the management of electric bicycles according to their respective responsibilities. Fifth electric bicycle drivers should abide by the provisions of road traffic safety, urban management, fire safety and other relevant laws and regulations, drive safely and civilized, park their vehicles in an orderly manner, and maintain fire safety. Article 6 Electric bicycle-related industry associations shall establish and improve industry norms, strengthen industry self-discipline, guide, supervise and coordinate member units to engage in business activities such as production, sales, maintenance, leasing and recycling according to law, and promote the healthy development of the industry. Seventh state organs, enterprises and institutions, social organizations and other organizations shall carry out safety education on electric bicycles for their own personnel.

schools should incorporate the traffic safety and fire safety education of electric bicycles into the publicity and education of the rule of law.

Press and publication, radio and television, and Internet information service providers should carry out public welfare publicity on civilized travel, traffic and fire safety of electric bicycles. Article 8 The people's governments of cities and counties (cities, districts) shall publicize the ways of complaints and reports to the public and handle relevant complaints and reports according to law. Chapter II Production, Sales, Maintenance and Recycling Article 9 Electric bicycles produced and sold in this Municipality shall meet the national standards and obtain compulsory product certification. Article 1 A seller of electric bicycles shall abide by the following provisions:

(1) Verify the conformity certificate and other marks of electric bicycles, and establish a ledger for purchasing goods and real-name registration system sales;

(2) establish an express notification system, and promise consumers that the electric bicycles they sell comply with the provisions of these regulations through public notices and sales vouchers;

(3) Provide consumers with product quality certificates and invoices when selling, and inform them of the safe driving knowledge and precautions of the sold electric bicycles;

(4) Prompt or help consumers to register after the sale.

if the electric bicycles purchased after the implementation of these regulations are not registered because they do not meet the national standards, consumers can ask the sellers to return or exchange them. Article 11 electric bicycle repairers shall abide by the following provisions:

(1) Use electric bicycle spare parts that have passed the quality inspection and meet the corresponding standards;

(2) The motor repaired or replaced meets the rated power set by the original vehicle, and the replacement motor code shall be indicated in the invoice;

(3) The repaired or replaced battery meets the rated voltage and specified current set by the original vehicle;

(4) other provisions of laws and regulations on the maintenance of electric bicycles. Article 12 No unit or individual may commit the following acts:

(1) Assembling electric bicycles;

(2) refitting the power device and speed limiting device of the electric bicycle;

(3) Add the hood, umbrella, seat (except child safety seat), carriage, bracket and other devices that change the appearance structure and affect driving safety on the electric bicycle;

(4) refitting and installing high-intensity lighting devices, reflective devices, high-decibel speakers, stereos and other devices that affect traffic safety;

(5) change the code of the whole electric bicycle;

(6) Other acts of installation and modification that affect the traffic safety of electric bicycles. Thirteenth electric bicycle waste batteries shall be disposed of in accordance with the relevant provisions of the prevention and control of solid waste pollution, and shall not be discarded at will.

The seller of electric bicycle batteries should provide the service of replacing and recycling the used batteries, and hand them over to qualified units for unified treatment. Fourteenth to encourage electric bicycle manufacturers, sellers and maintainers to take the old for the new, buy back at a discount and other ways to recycle used electric bicycles and electric bicycles that do not meet the national standards.
