Measures of Shenzhen Municipality on the Administration of Underground Comprehensive Tunnels (for Trial Implementation)

Chapter I General Provisions Article 1 In order to standardize the planning, construction, operation and maintenance of underground common ditches, co-ordinate the laying of various pipelines, intensively use underground space and improve the comprehensive carrying capacity of cities, these measures are formulated in accordance with the provisions of relevant laws and regulations and combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the planning, construction, operation and maintenance of underground common ditches within the administrative area of this Municipality. Article 3 The underground utility tunnel as mentioned in these Measures (hereinafter referred to as the pipe gallery) refers to the structures and ancillary facilities built underground in cities to accommodate more than two kinds of urban engineering pipelines.

The term "urban engineering pipelines" as mentioned in these Measures refers to pipelines of municipal public facilities such as water supply, drainage, reclaimed water, gas, heat, refrigeration, electricity, communication, lighting, radio and television, traffic signals, etc. Meet the needs of citizens' life and production.

The term "ancillary facilities" as mentioned in these Measures includes facilities such as fire fighting, drainage, ventilation, lighting, power supply, communication, and safety monitoring that support the normal operation of the pipe gallery. Article 4 The management of pipe corridors shall follow the principles of government leading, market participation, planning first, overall planning, compulsory access to corridors and paid use. Article 5 The Municipal People's Government shall set up a comprehensive coordination organization for the construction and management of pipe corridors, make overall plans for the management of pipe corridors, and improve the scientific, holistic and systematic planning and construction of pipe corridors.

The district people's governments (including the new district management agencies, the same below) are responsible for the planning and construction of pipe corridors within their respective jurisdictions in accordance with the provisions on the division of investment authority of city governments. Article 6 The municipal housing and construction department is the competent department of this Municipality's pipe gallery, and shall perform the following duties:

(a) to organize the formulation of pipe gallery management policies and regulations, development strategy, annual construction plan and technical specifications;

(two) to promote the simultaneous construction of pipe corridors and other municipal infrastructure, and to guide and supervise all kinds of pipelines to enter the pipe corridors;

(three) responsible for the supervision and inspection of the construction and operation of the pipe gallery, establish the inspection and assessment mechanism and organize the implementation;

(four) to guide the pipe gallery operation units and pipeline units to formulate comprehensive emergency plans for pipe galleries;

(five) to assist the relevant departments to clarify the investment and financing methods, paid use and financial subsidy mechanism for the construction and operation of pipe corridors;

(six) other duties authorized by laws, regulations and rules and the Municipal People's government. Article 7 The transportation department is responsible for supervising and managing the construction of the pipe gallery project which is synchronized with the road project and issued by it, and cooperating with the daily maintenance and emergency rescue work of the pipe gallery within the red line of road land.

The water department is responsible for the supervision and management of the pipe gallery construction synchronized with the water project, and cooperates with the daily maintenance and emergency rescue work of the pipe gallery construction synchronized with the main water project.

The housing construction department is responsible for the construction permit, supervision and management of the pipe gallery project as stipulated in the first and second paragraphs of this article. Article 8 The planning and land department is responsible for organizing the preparation of special planning for pipe corridors, land management and surveying and mapping management for pipe corridor project planning, implementing the requirements for pipeline entering corridors according to the division of responsibilities, and managing pipe corridor information.

The development and reform department is responsible for the project establishment and investment plan management of the pipe gallery, and guides the establishment of the paid use mechanism of the pipe gallery.

The financial department is responsible for the financing, arrangement and supervision of the pipe gallery construction funds and financial subsidies, and do a good job in the preparation of the annual budget.

The emergency management agency is responsible for coordinating the emergency rescue work caused by the pipe gallery accident.

Urban construction archives management institutions are responsible for the management of pipe gallery construction archives, and cooperate with the planning and land departments to manage pipe gallery information.

Gas, heat, electricity, communications and other pipeline industry management departments shall, in accordance with the division of responsibilities, jointly promote the construction of pipe corridors and the work of pipe corridors. Article 9 The municipal people's government, relevant departments and units shall, in accordance with the People's Republic of China (PRC) Law on Work Safety and other laws, regulations, rules and regulations related to work safety planning, perform their duties of supervision and management of work safety in the process of planning, construction, operation and maintenance of the pipe gallery. Tenth pipe gallery construction adopts the combination of government investment, social investment and cooperative investment between government and social capital.

Government investment can be carried out through direct investment, capital injection and fixed-price investment.

The government can promote social capital to participate in the investment and construction of the pipe gallery through franchising, investment subsidies, loan interest subsidies and land use rights.

The property right, construction, operation and maintenance of the pipe gallery in which social capital participates in investment shall be determined by the investment agreement. Eleventh pipe gallery engineering design should consider the requirements of access, laying, expansion, branch lines and other pipelines, adjust measures to local conditions, meet relevant standards and technical specifications, and ensure the safe operation of pipe gallery.

The municipal housing and construction department shall, jointly with the relevant departments of land planning, transportation, water affairs, electric power, etc., formulate relevant technical specifications for pipe gallery projects in line with the actual situation of our city. Article 12 The pipe gallery built by the Municipal People's Government in full shall be built by the relevant functional departments, government investment project construction institutions or municipal infrastructure investment platform companies determined by the Municipal People's Government, and the municipal infrastructure investment platform companies shall hold the property rights of the pipe gallery.

The pipe gallery fully funded by the District People's Government shall be constructed by relevant functional departments, government-invested project construction institutions or units determined by the District People's Government, and the units determined by the District People's Government shall hold the property rights of the pipe gallery.

The municipal infrastructure investment platform company specified in this article, the pipe gallery property right holding unit designated by the District People's Government and the pipe gallery property right unit determined in the investment agreement in Paragraph 4 of Article 10 are collectively referred to as the pipe gallery property right unit.
