What procedures and materials are needed for marriage registration?

The marriage registration process is roughly as follows:

(1) Application

Those who meet the requirements for applying for marriage registration, with their own registration photos, relevant certificates and supporting materials, both parties apply for marriage registration at the marriage registration office where one party's permanent residence is located, and fill in the application registration statement according to the guidance of the staff.

The preparation materials for marriage registration application depend on the specific circumstances. For example, when China citizens apply for marriage registration in China, they need to hold their valid ID card, household registration book, marriage examination certificate, single certificate and a statement that they are not related by blood (lineal blood relatives and collateral blood relatives within three generations) and other materials. If they are divorced, they should also bring divorce papers.

Foreigners, such as foreigners living in China, overseas Chinese, etc. To apply for marriage registration in China, one must hold a valid passport or other identification, nationality certificate, a foreigner's residence permit issued by the public security organ or a valid temporary residence permit in China, and a certificate of marital status issued by a domestic notary office certified by the Ministry of Foreign Affairs (or an authorized organ of the Ministry of Foreign Affairs) and China's embassy or consulate in that country.

(2) Review

The application of the parties will be examined by the marriage registration authority to find out whether the marriage application is correct. If there is any ambiguity, the marriage registration authority will ask the parties concerned and ask them to provide relevant materials for marriage registration application when necessary.

(3) Registration and licensing

The marriage registration authority shall register those who meet the conditions for marriage and issue a marriage certificate; For divorced people, the marriage registration office will cancel their divorce certificates; According to the request of the parties, the marriage registration authority will issue a written statement to those who do not meet the conditions for marriage, explaining the reasons for not registering.

What procedures and documents do you need for divorce?

The process of divorce registration is roughly as follows:

(1) Application

If both husband and wife want a divorce, they shall sign a written divorce agreement and apply to the marriage registration office (which has jurisdiction), and provide the following documents and supporting materials:

2. Relevant valid identity documents that meet the requirements, such as household registration book, ID card, Hong Kong, Macao and Taiwan pass, passport, etc. ;

3. Fill in the application related to divorce registration.

(2) Accept

After verifying the application materials submitted by the parties, the staff will issue the Receipt for Accepting the Application for Divorce Registration. If the application conditions for divorce registration are not met, the marriage registration authority will not accept it, and if the party concerned requests to issue a notice of not accepting the application for divorce registration, it shall issue it.

(3) cooling-off period

Within 30 days from the date when the marriage registration office receives the application for divorce registration and issues the Receipt for Accepting the Application for Divorce Registration to the parties concerned, if either party is unwilling to divorce, it can withdraw the previously submitted application for divorce registration from the divorce registration office that accepts the application for divorce registration with relevant materials, such as its valid identity card and receipt for accepting the application for divorce registration (the receipt may not be provided if it is lost, but the situation needs to be explained in writing), and fill out the Application for Withdrawing the Registration of Divorce in person. After verifying the information, the marriage registration authority will issue the Confirmation Form for Cancellation of Divorce Registration. Within 30 days after the expiration of the cooling-off period for divorce, if both parties fail to jointly apply to the marriage registration office for a divorce certificate, the application for divorce registration shall be deemed to have been withdrawn.

(4) review

Within 30 days after the expiration of the cooling-off period for divorce (if the last day of the cooling-off period expires is a holiday, the first day after the holiday will be the date of the cooling-off period), both parties shall apply to the marriage registration office for a divorce certificate with recent bareheaded photos, divorce agreement, marriage certificate, ID card, passport or pass and other relevant documents and materials. The marriage registration office will be implemented and reviewed according to the regulations, and the parties who do not meet the requirements for divorce registration will not be handled. When necessary, the marriage registration office may issue a notice not to register for divorce at the request of the parties.
