What if my wife is abused?

Provisions on domestic violence in the Criminal Law;

1. Civil liability for compensation: A party who commits domestic violence against others and causes personal injury shall bear civil liability for compensation.

2. Administrative punishment: If domestic violence is committed and the victim requests it, the public security organ shall impose administrative punishment in accordance with the Law on Public Security Administration Punishment.

3. Criminal responsibility: if the circumstances of domestic violence are bad, it constitutes a crime of abuse, and criminal responsibility shall be investigated according to law. According to Article 260th of the Criminal Law, whoever maltreats a family member, if the circumstances are bad, shall be sentenced to fixed-term imprisonment of not more than two years, criminal detention or public surveillance. Whoever commits the crime mentioned in the preceding paragraph and causes serious injury or death shall be sentenced to fixed-term imprisonment of not less than two years but not more than seven years.

4. Crime of intentional injury: if one party commits domestic violence and causes the other party to be slightly injured or more, it constitutes the crime of intentional injury. Whoever commits this crime shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance. Whoever intentionally harms another person's body shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance. Whoever commits the crime mentioned in the preceding paragraph and causes serious injuries shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years.

5. Crime of maltreatment: maltreating family members, if the circumstances are bad, shall be sentenced to fixed-term imprisonment of not more than two years, criminal detention or public surveillance. Whoever commits the crime mentioned in the preceding paragraph and causes serious injury or death shall be sentenced to fixed-term imprisonment of not less than two years but not more than seven years. The crime in the first paragraph shall be dealt with only if it is told, except that the victim can't tell it, or because of coercion or intimidation.
