At present, there are two ways of divorce in China: litigation divorce and agreement divorce.

After the cooling-off period of divorce expires, both husband and wife can apply to the marriage registration authority for divorce certificate with the required documents and materials. After receiving the divorce certificate, the marriage relationship between the two parties is dissolved.

If the husband and wife fail to reach an agreement on divorce, child support, property division and other issues, there is no way to reach a divorce agreement at this time and it needs to be resolved through litigation, that is, litigation divorce. Generally, when a plaintiff files a divorce lawsuit in the people's court of the defendant's domicile, it is necessary for the plaintiff to prepare a complaint, a marriage certificate, ID cards of both husband and wife, proof of children's identity, property-related evidence and other materials, and submit them to the court for filing. After the court accepts the case, it will first mediate and decide whether to make a mediation book according to the specific circumstances of mediation. If mediation fails, a trial will be held, and the judge will reconsider mediation according to the trial situation. If mediation fails at this time, a verdict will be pronounced. For cases that are not allowed to divorce, they can be prosecuted after half a year; In cases where divorce is granted by judgment, the marriage relationship shall be dissolved after the judgment takes effect.
