Regulations of Guangdong Province on Green Building

Chapter I General Provisions Article 1 In order to implement the concept of green development, promote the high-quality development of green buildings, standardize green building activities, save resources and improve the quality of human settlements, these Regulations are formulated in accordance with the People's Republic of China (PRC) Building Law, the People's Republic of China (PRC) Energy Conservation Law, the Civil Building Energy Conservation Regulations and other laws and administrative regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to the planning, construction, operation, transformation, supervision and management of green buildings within the administrative area of this province.

The term "green building" as mentioned in these Regulations refers to high-quality civil buildings that save land, water, energy, building materials and other resources, protect the environment, reduce pollution, provide people with healthy, applicable and efficient use space, and realize the harmony between man and nature. Article 3 The people's governments at or above the county level shall promote the development of green buildings, incorporate them into the national economic and social development plan, formulate corresponding policies and measures, define the development goals, and take the completion of the goals as the content of government assessment. Fourth people's governments at or above the county level shall be responsible for the supervision and management of the development of green buildings and related activities within their respective administrative areas.

The competent departments of development and reform, finance, natural resources, ecological environment, science and technology, and comprehensive law enforcement of urban management of the people's governments at or above the county level shall do a good job in the development of green buildings in accordance with their respective responsibilities. Article 5 People's governments at or above the county level shall provide financial guarantee for promoting the development of green buildings and guide social capital to invest and operate green buildings. Article 6 The competent departments of housing and urban and rural construction of the people's governments at or above the county level shall carry out green building publicity through green building project display, product display, technical exchange, design competition and other forms, popularize the professional knowledge of green building, and raise the awareness of urban and rural residents on green building.

Encourage green building industry associations to play a role in green building publicity and training, technology promotion and information consultation. Seventh people's governments at or above the county level and their relevant departments shall encourage the development of green building industry, support the research, development, demonstration, achievement transformation and popularization and application of green building technology, and promote the progress and innovation of green building technology.

Units and individuals that have made remarkable achievements in the development of green buildings shall be commended and rewarded in accordance with the relevant provisions of the state and province. Chapter II Planning and Construction Article 8 The competent departments of housing and urban construction of people's governments at the prefecture level and at the county level shall, jointly with the competent departments of development and reform, natural resources and other departments, organize the preparation of special plans for the development of green buildings in their respective administrative regions, and announce them to the public after being approved by the people's governments at the corresponding levels.

The special plan for the development of green buildings shall specify the development objectives, key development areas, new technical routes and green transformation of existing civil buildings, and determine the green building indicators and layout requirements of various civil buildings and green ecological cities, communities and residential areas.

The special planning for the development of green buildings shall conform to the national spatial planning, and be connected with the relevant special planning such as ecological environment protection, comprehensive utilization of energy, comprehensive utilization of water resources, development and utilization of underground space, comprehensive utilization of solid waste, and urban infrastructure. Ninth green buildings in accordance with the provisions of the state to implement hierarchical management.

The competent department of natural resources of the people's government at or above the county level shall incorporate the relevant contents of the special planning for the development of green buildings into the regulatory detailed planning, and clarify the requirements for the grade of green buildings in the planning conditions of construction land according to the regulatory detailed planning.

The assignment contract of the right to use state-owned construction land or the decision on the allocation of state-owned land and the construction project planning permit shall indicate the requirements of green building grade. Article 10 The competent department of housing and urban construction of the provincial people's government shall, jointly with relevant departments, establish and improve the standard system of green buildings in accordance with state regulations, and determine the grade, technical requirements and valuation basis of green buildings. Eleventh new civil buildings should be built in accordance with green building standards. Large public buildings invested by state-owned funds, office buildings of state organs and other public buildings shall be built in accordance with the green building standards higher than the lowest level.

The people's governments at the prefecture level and listed on the market can improve the requirements of green building development in light of local conditions, and formulate and implement higher requirements for green building standards.

Nine cities in Guangdong-Hong Kong-Macao Greater Bay Area, such as Guangzhou, Shenzhen, Zhuhai, Foshan, Huizhou, Dongguan, Zhongshan, Jiangmen and Zhaoqing, should speed up the development of green buildings in accordance with national and provincial requirements, and carry out construction at least two grades higher than the minimum green building standard in a certain area. The specific regional scope is determined in the special planning of green building development. Twelfth construction units shall carry out construction in accordance with the requirements of the green building grade indicated in the construction project planning permit.

The construction unit shall strengthen the quality management of the whole process of green building construction and assume the responsibility of project quality management of the construction unit. The feasibility study report or project application report of the newly-built civil construction project shall include a special article on green building, specify the green building grade, technology, energy saving and emission reduction, and include the related expenses of green building into the project investment budget.

When the construction unit entrusts the design, construction and supervision of new civil construction projects, it shall specify the requirements of green building grade in the contract. The construction unit shall not express or imply that the entrusted unit violates the green building standards for project design, construction and supervision.

If a newly-built civil construction project should be subject to design bidding according to law, the tenderer shall specify the requirements for the green building grade of the project in the design bidding documents.
