Chapter V Regulations of road administration of Heilongjiang Province

Article 22 The minimum distance between the building control area on both sides of the highway and the outer edge of the specified highway side ditch is 3.5 meters and the slope angle of the headless ditch shall meet the following requirements:

(a) the national highway is not less than 20 meters;

(two) the provincial highway is not less than 15 meters;

(3) County roads and township roads shall not be less than 10 meter, which shall be determined and controlled by the county (city) people's government due to special needs.

The building control area on both sides of the expressway and the first-class highway is not less than 50 meters, and the second-class highway is not less than 20 meters.

Twenty-third highway construction control areas prohibit the construction of buildings and ground structures.

Buildings and ground structures incorporated into the highway control area due to the adjustment of the newly built or rebuilt highway construction control area shall not be expanded or rebuilt. When necessary for highway construction, the local people's government shall be responsible for relocation and resettlement.

Article 24 No unit or individual is allowed to set up signs, billboards, propaganda slogans, plaques and other off-highway signs within the scope of highway land without authorization. If it is really necessary to set it up within the scope of highway land beyond zero kilometers, it shall be approved by the highway management agency.

Twenty-fifth in the national, provincial and county roads on both sides 150 meters and within 50 meters under the highway subgrade, no sand digging, quarrying, earth borrowing, dumping of waste, blasting operations and other activities endangering highway safety are allowed.

Article 26 No unit or individual is allowed to set up stalls, pile up articles, dry grain on the threshing floor, dump garbage, set up obstacles, dig ditches to divert water, plant crops, raise animals, park vehicles indiscriminately, use roadside ditches to discharge pollutants or engage in other activities that damage, pollute and affect the smooth flow of roads.

It is forbidden for vehicles driving on toll roads to leave behind, drip, flow, or inspect, teach or park at will.

Twenty-seventh expressways and closed sections of expressways prohibit the following acts:

(1) Stop or inspect the vehicle;

(2) Parking passengers;

(3) Non-motor vehicles, pedestrians and livestock enter.

Twenty-eighth highway management agencies at all levels should set up safety barriers at both ends of unguarded highway crossings in addition to setting up signs of slowing down.

Twenty-ninth of the roads that have been included in the highway development plan are newly built or rebuilt, and the transportation departments shall notify the relevant departments in advance, and the relevant departments shall not approve the construction of buildings and ground structures in the building control area.

Thirtieth of the upcoming projects and highways under construction, highway management agencies should implement road management according to law.

Article 31 No crossing shall be added on the highway without authorization. If it is really necessary to add a crossing, it must be approved by the highway management agency. Grade crossing, which is approved to be added, shall be built in accordance with the technical standards for highway engineering stipulated by the state. And pay the relevant fees to the highway management agencies. The new crossing shall be subject to the annual inspection system. Because of the need of highway reconstruction and widening, users must dismantle it unconditionally.

The original examination and approval of the plane crossing did not meet the technical standards of highway engineering, should reach the standard within a time limit.

Thirty-second vehicles with axle load exceeding the requirements of technical standards for highway engineering must be approved by highway management organizations, and bear the technical protection measures taken by highway management organizations and the expenses required for repairing damaged parts.

Article 33 No unit or individual may occupy or dig highways, special highways and land for highways without authorization. If it is really necessary to occupy the excavation, it must be approved by the highway management agency and pay the relevant fees. If the loss of highway property is caused, compensation shall be made.

The relevant expense standards for occupying and excavating highways, special highways and land for highways shall be formulated by the provincial people's government.

Article 34 When a traffic accident occurs on an expressway, the relevant domestic departments should rush to the scene in the shortest time to divert traffic. After the on-site investigation is completed, the public security traffic management department or highway management institution shall be responsible for removing obstacles.
