Chapter I General Principles

Article 3 The expressway management in the whole province must adhere to the principles of centralization, unification, high efficiency and special management.

Article 4 The traffic administrative department of the provincial people's government is the competent department of expressway management in the whole province, and its subordinate provincial expressway management department is specifically responsible for the supervision and management of expressway maintenance, road administration, toll collection, communication monitoring and comprehensive services in the whole province.

The provincial public security organ is the competent department of highway traffic safety in the province, which implements unified management of highway traffic safety in the province, and its subordinate public security traffic management department is responsible for the coordination and guidance of highway traffic safety management in the province. Public security traffic management departments at all levels along the expressway are responsible for the supervision and management of expressway traffic safety in their respective jurisdictions.

The people's governments at all levels along the expressway and the relevant departments of the provincial people's government shall assist in the management of the expressway.

Chapter II Maintenance and Management

Article 5 Highway management departments shall, in accordance with highway maintenance standards, strengthen the maintenance and repair of highways and their facilities and keep them in good condition.

Article 6 Highway maintenance personnel and other approved personnel must wear uniform safety identification uniforms when working on highways. The construction site must set up construction warning signs, speed limit signs, guide signs and necessary safety protection facilities according to relevant regulations. Article 7 When roads are damaged due to natural disasters and traffic is seriously blocked, highway management departments must take emergency measures to restore traffic as soon as possible. The local people's government should mobilize troops, organs, organizations, schools, enterprises, institutions and urban and rural residents near the expressway to assist the expressway management department in removing roadblocks or repairing the expressway to ensure the safety and smoothness of the expressway.

Chapter III Road Administration

Article 8 The following acts endangering the safety of expressways and their facilities are prohibited:

(1) Occupy, dismantle, move, pollute or damage expressways and their facilities;

(2) Test braking on the expressway;

(3) Borrowing soil, piling up sundries, planting crops, dumping garbage, and ditching for water diversion within the scope of expressway land use;

(four) the use of highway drainage, irrigation, fish farming;

(5) Digging sand and quarrying, compressing or widening the riverbed, and carrying out underwater blasting within 200m of the upstream and downstream of middle and large bridges on expressways;

(6) Damming within the range of 100 meters in the middle of the expressway and upstream and downstream of the bridge;

(seven) engaged in blasting, quarrying, logging and soil borrowing above the expressway tunnel and within the safety range of the tunnel;

(eight) set up signs and billboards on the bridge (including the overpass bridge);

(nine) other acts endangering highway safety.

Chapter IV Traffic Management

Article 16 Vehicles driving on expressways must meet the technical standards for motor vehicle safety stipulated by the state, and must be equipped with fault warning signs and fire extinguishers.

Article 17 Pedestrians, non-motor vehicles, tractors, battery cars, agricultural transport vehicles, wheeled special machinery, full-trailer tractors and motor vehicles with a designed maximum speed of less than 70 kilometers per hour are prohibited from entering the expressway, except for personnel, machinery and vehicles performing expressway management tasks and maintenance operations.

Chapter V Charge Management

Twenty-ninth all vehicles passing through the expressway must pay vehicle tolls according to the relevant provisions of the state and the province.

Chapter VI Reward and Punishment

Thirty-third units and individuals in any of the following circumstances in the implementation of this Ordinance shall be commended or rewarded by the provincial people's government or the provincial traffic administrative department:

(1) Eliminate or report hidden dangers of expressways and their facilities in time to avoid heavy losses;

(two) outstanding achievements in highway rescue work;

(three) report, expose or investigate the theft, destruction of highways and their facilities, forgery of highway toll bills, and serious evasion of highway tolls.

Thirty-fourth in violation of the provisions of article eighth of these regulations, the highway management department shall order it to immediately stop the harmful behavior and restore the original state. If the expressway and its facilities are not damaged, a fine of 1000 yuan shall be imposed; Causing damage to roads and their facilities, in addition to ordering them to compensate economic losses according to regulations, they shall also be fined less than twice the compensation fee for road property losses.

Article 35 Whoever, in violation of the provisions of Article 9 of these regulations, conducts operations on the expressway without authorization shall be ordered by the traffic administrative department of the public security to stop operations and be fined 1000 yuan; Unauthorized use of highway land and facilities to build bridges, aqueducts, pipelines and other cross (cross) highway facilities, the highway management department shall order it to stop operations; Causing damage to the road property, in addition to ordering it to compensate for the losses, a fine of less than 50% of the road property losses shall be imposed.

Thirty-sixth in violation of the provisions of article tenth of these regulations, the highway management department shall order it to stop work immediately, and may impose a fine of 1000 yuan; The completed facilities shall be ordered to be dismantled within a time limit or forcibly dismantled; If losses are caused to road property, it shall be ordered to compensate for the losses and be fined twice the compensation fee.

Thirty-seventh in violation of the provisions of article eleventh of these regulations, the highway management department shall order it to be demolished, collect the occupation fee in accordance with the relevant provisions, and impose a fine of 1000 yuan.

Thirty-eighth in violation of the provisions of Article 12 of these regulations, the highway management department may order it to stop, go through the relevant formalities, and impose a fine of 1000 yuan; Damage to road property, in addition to compensation for the actual damage, the highway management department shall impose a fine of less than twice the compensation fee for road property losses.

Thirty-ninth in violation of the provisions of article thirteenth of these regulations, causing corrosion and pollution of highways and their facilities, in addition to collecting compensation fees according to regulations, the highway management department shall impose a fine of 20% of the compensation fees.

Fortieth in violation of the relevant provisions of Chapter IV of these regulations, the traffic administrative department of the public security shall give a warning, impose a fine of not more than 50 yuan, and may also suspend the driver's license for not more than 6 months; If the circumstances are serious, you can be fined from 50 yuan to 200 yuan, and you can also suspend your driver's license for more than 6 months 12 months.

Forty-first in violation of the provisions of article seventeenth of these regulations, pedestrians, non-motor vehicle drivers and other personnel in traffic accidents caused their own casualties and property losses, the normal driving of motor vehicles will not bear the responsibility for traffic accidents.

Article 42 Whoever, in violation of the provisions of Article 29 of these regulations, forcibly passes through without paying the highway toll or otherwise evades paying the highway toll, in addition to paying the toll, the highway management department shall impose a fine of 1000 yuan to 2,000 yuan. Refuse to accept the investigation, you can take measures to suspend vehicle operation.

Article 43 whoever, in violation of the provisions of these regulations, alters the expressway toll bill or uses the waste bill, the expressway management agency may impose a fine of more than 2,000 yuan but less than 65,438 yuan in addition to paying the toll; Highway management departments may impose a fine of 100 times the denomination of forged highway vehicle toll bills; If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 44 If a party refuses to accept the decision on administrative punishment, it may apply for reconsideration or bring a lawsuit according to law. If it fails to apply for reconsideration, bring a suit in a people's court or perform the punishment decision within the time limit, the organ that made the punishment decision may apply to the people's court for compulsory execution.

Article 45 If the staff of expressway management departments and public security traffic management departments abuse their powers, neglect their duties or engage in malpractices for selfish ends when performing their duties, which does not constitute a crime, they shall be given administrative sanctions by the competent authorities; If a crime is constituted, criminal responsibility shall be investigated according to law.

Chapter VII Supplementary Provisions

Article 46 The meanings of the following terms in these Regulations are:

"Expressway" refers to a road built in accordance with the national highway engineering technical standards, equipped with expressway signs and related facilities for cars to drive at high speed in a single lane, and all access is controlled.

"Expressway land" refers to the land requisitioned according to law outside the side ditches and side ditches on both sides of the expressway.

"Expressway facilities" refers to drainage facilities, protective structures, traffic engineering facilities, safety facilities, lighting facilities, communication facilities, maintenance facilities, service facilities, monitoring facilities, detection facilities, boundary markers, survey piles, mileage cards, signs, flowers, trees and special houses.

Article 47 The management of automobile-only highways subject to comprehensive control and toll collection shall be implemented with reference to these Regulations.

Forty-eighth specific issues in the application of these Regulations shall be interpreted by the provincial administrative department of transportation. Involving traffic safety management, the provincial public security organs shall be responsible for the interpretation.

Article 49 These Regulations shall come into force as of the date of promulgation.
