Regulations of Southwest Guizhou Buyi and Miao Autonomous Prefecture on Funeral Management

Article 1 In order to promote funeral reform, strengthen funeral management and standardize funeral activities, these Regulations are formulated in accordance with the Law on Regional Ethnic Autonomy in People's Republic of China (PRC), the Regulations on Funeral Management in the State Council and relevant laws and regulations, combined with the actual situation in Southwest Guizhou. Article 2 These Regulations shall apply to funeral management, funeral activities and funeral services within the administrative area of Autonomous Prefecture. Article 3 Funeral management shall follow the principles of people-oriented, facilitating the people, saving resources, protecting the environment, changing customs, being civilized and frugal. Article 4 The people's governments of autonomous prefectures and counties (cities) shall strengthen their leadership over funeral work, formulate funeral work plans, and incorporate the construction of funeral service facilities such as funeral parlours, crematoriums, ashes storage places, urban cemeteries, and rural public welfare cemeteries into the overall land use planning and urban and rural construction planning. Article 5 The civil administration departments of the people's governments of autonomous prefectures and counties (cities) shall be responsible for the funeral management within their respective administrative areas.

Public security, land resources, forestry, housing and urban and rural construction, urban management, price, planning, environmental protection, health and family planning, industry and commerce, food and drug supervision and management, ethnic and religious departments shall, according to their respective functions and duties, do a good job in funeral management.

Township People's governments (street offices) should strengthen the management of rural public welfare cemeteries, and burial reform areas should set up rural public welfare cemeteries reasonably according to needs. Article 6 The people's governments of autonomous prefectures and counties (cities) shall actively carry out funeral services for the benefit of the people, and gradually incorporate basic funeral services such as body pick-up, hall rental, cold storage, cremation and ashes storage into the scope of government services, so as to continuously improve the level of funeral services. Article 7 The cremation area and the scope of centralized funeral shall be carried out step by step according to the city first and then the township. Cremation will be carried out in densely populated areas with little arable land and convenient transportation, and burial reform will be carried out in other areas.

Delineation of cremation area and burial reform area shall be proposed by the county (city) people's government, audited by the state people's government and approved by the provincial people's government.

The place and scope of centralized mourning shall be designated by the county (city) people's government. Article 8 Centralized funeral and interment shall be conducted at the place designated by the county (city) people's government. The relatives of the deceased or the undertaker of the funeral shall promptly notify the funeral service institution to collect the remains. The funeral service institution shall promptly pick up the remains and be responsible for providing services such as preservation, cold storage and cremation of the remains.

Funeral activities shall not interfere with social order and affect city appearance and environmental sanitation. Article 9 If a citizen dies in a cremation area, his remains shall be cremated, and his ashes shall be buried in a cemetery and stored in an ashes storage place, or under the guidance of the funeral management department, ecological burial methods such as scattered burial, tree burial, flower burial and lawn burial shall be adopted.

In areas where burial reform is implemented, the remains should be buried in cemeteries.

If the remains that should be cremated are buried in the ground, the funeral service is not concentrated, and the remains or ashes are not buried in the cemetery, the original unit of the deceased shall not issue funeral subsidies and pension subsidies.

Respect the funeral customs of ten ethnic minorities, including the Hui nationality, as stipulated by the state. Article 10 It is forbidden to build new graves in urban planning areas, scenic spots above AAAA and the core areas of water source protection areas. The original unsightly graves should be moved out within a time limit or buried deep without leaving tombstones.

The original graves on both sides of national highways, provincial highways and other traffic trunk lines and within the visual range of scenic spots should be covered by greening. Eleventh cemeteries are divided into operating cemeteries and rural public welfare cemeteries. Operating cemeteries are used by urban residents and other citizens; Rural public cemetery is used by rural villagers. The choice of cemetery should comply with relevant laws and regulations. Encourage and guide social capital to invest in the construction of operating cemeteries, and allocate them to public welfare cemeteries of not less than 5% for free. Public cemetery can enjoy land and tax concessions.

Cemetery areas should be built in the form of gardens. Tombs and epitaphs advocate miniaturization and artistry Twelfth in the funeral activities prohibit the following acts:

(1) Mourning, burning and scattering money, paper money and fireworks in tents outside the centralized funeral area;

(2) Building graves in places other than cemeteries;

(3) Burying remains and human remains in cemeteries in cremation areas;

(4) Burying the ashes in the coffin;

(five) unauthorized transfer of acupuncture points in the cemetery or placing ashes;

(six) rural public cemetery for business;

(7) Burying the remains of non-members of the collective in rural public welfare cemeteries. Thirteenth funeral service institutions shall establish cremation files of the deceased's remains and keep them properly. Respect the personal rights and interests of the deceased, and shall not illegally use or damage the remains of the deceased. Fourteenth cemetery prices and funeral service charges shall be examined and approved by the competent price administrative department with examination and approval authority, and shall be supervised according to law. Fifteenth funeral service institutions shall implement a competitive management mechanism for catering services in centralized funeral places and operate according to law.

Catering service operators shall ensure food safety. Sixteenth the implementation of civilized and green sacrifices. Promote the use of flowers, tree planting and greening to remember the old friends. Funeral service institutions shall build fireworks and firecrackers in funeral service places and set up necessary fire-fighting equipment. It is strictly forbidden to use open flames and set off fireworks and firecrackers in non-designated areas to prevent fire safety accidents.
