Notice of the Ministry of Agriculture and the State Administration for Industry and Commerce on Issuing the Interim Measures for the Administration of Crop Seed Production and Operation

Chapter I General Provisions Article 1 In order to strengthen the management of crop seed production and operation, these measures are formulated in accordance with relevant state laws and regulations. Article 2 Agricultural administrative departments and industrial and commercial administrative departments at all levels shall, according to their respective functions and duties, be responsible for the production, operation and market supervision and management of crop seeds according to law. Third units and individuals engaged in crop seed production and business activities within the territory of People's Republic of China (PRC) shall abide by the provisions of these measures. Chapter II Management of Crop Seed Production Article 4 Units and individuals engaged in the production of commercial crop seeds must apply to the administrative department of agriculture for a crop seed production license and produce with a certificate. Article 5 Units and individuals engaged in seed production of cash crops must meet the following conditions to obtain the Crop Seed Production License:

(a) there is a production base for crop seeds, with isolated cultivation conditions for breeding and producing original seeds or improved varieties, and no quarantine pests and diseases;

(two) there are professionals familiar with crop seed production technology;

(three) the variety (combination) of crop seeds should be the variety (combination) that has been examined and approved;

To breed crop seeds of varieties (combinations) that have not been approved in this province but have been approved in other provinces, there must be an appointment production contract from other provinces and relevant documents to prove that the varieties (combinations) have passed the approval from other provinces;

To produce foreign varieties (combinations) of crop seeds, there must be an appointment production contract, the approval document of the provincial agricultural administrative department allowing the varieties (combinations) to breed in the province, and the quarantine certificate;

(four) to provide reliable field inspection results for the production of crop seeds;

(five) the application for the production of hybrid seeds of major crops and their parents must be included in the production plan of the local provincial agricultural administrative department. Sixth "crop seed production license" shall be subject to grading examination and approval system.

Where hybrid seeds, hybrid parent seeds and conventional crop seeds are produced, the agricultural administrative department at the provincial level where the production is located shall issue a crop seed production license.

The "Crop Seed Production License" for the production of other crop seeds shall be issued by the agricultural administrative department at the county level where the production is located. Seventh units and individuals engaged in crop seed production, shall submit an application to the administrative department of agriculture one month before sowing, and submit the following documents:

(a) the application form for crop seed production license signed by the person in charge of the unit;

(2) Brief introduction of crop seed production base;

(three) the technical qualification certificates of the main technical personnel.

After the approval of the administrative department of agriculture, the crop seed production license will be issued. Eighth "crop seed production license" is valid in a growth cycle of crops, and the seeds automatically become invalid after harvest. Chapter III Management of Crop Seeds Article 9 Units and individuals engaged in crop seed business must apply to the competent agricultural administrative department for a crop seed business license, register with the administrative department for industry and commerce with the crop seed business license and obtain a business license before engaging in business activities in accordance with the approved business scope, methods and places. Tenth units and individuals applying for the "crop seed business license" must meet the following conditions:

(1) Having a full-time seed quality inspector with the Certificate of Planting Inspector;

(2) Having keepers who are proficient in the storage and packaging technology of crop seeds;

(3) Having business premises, storage facilities and machinery, instruments and equipment for processing and testing the quality of crop seeds that are suitable for the types and quantities of business;

(4) Having its own funds suitable for the variety and quantity of crop seeds;

(5) Having qualified accountants and a sound financial management system.

The application for the Business License of Crop Seeds, which covers the hybrid seeds of major crops and their parents, must be a business unit designated by the local people's government at or above the county level in addition to the above conditions. Eleventh when applying for the "crop business license", the following documents must be submitted to the administrative department of agriculture:

(a) the application form for the business license of crop seeds signed by the person in charge of the unit;

(2) Technical qualification certificate of experienced personnel;

(3) If the business scope includes hybrid seeds of major crops and their parents, a document that the people's government at or above the county level agrees to designate them as a business unit shall also be submitted.

When an agricultural breeding scientific research unit applies for a business license for crop seeds whose business scope includes hybrid seeds of major crops and their parents, it must submit a variety approval (identification) certificate in addition to the above documents, which proves that the variety (combination) it applies for business is cultivated (or introduced) by the unit and has passed the approval. Twelfth "crop seed business license" to implement the grading examination and approval system.

The "Crop Seed Business License" for operating hybrid seeds of major crops and their parents' seeds shall be issued by the local provincial agricultural administrative department.

The "Crop Seed Business License" for operating other crop seeds shall be issued by the local agricultural administrative department at the county level.
