Provisions of Baotou Municipality prohibiting the sale of fireworks and firecrackers in some areas

Article 1 In order to protect the property and personal safety of the state, collectives and citizens, reduce urban environmental pollution and maintain social order, these Provisions are formulated in accordance with the provisions of relevant state laws and regulations and combined with the actual situation of this Municipality. Article 2 Fireworks and firecrackers mentioned in these Provisions refer to fireworks and firecrackers that can produce smoke and sound. Article 3 These Provisions shall be implemented by people's governments at all levels. The public security organ is the competent authority that prohibits the sale and discharge of fireworks and firecrackers. Fourth the following areas and regions prohibit the sale and discharge of fireworks:

(1) Kundulun District, Qingshan District, Donghe District and their urban-rural fringe;

(2) Areas within 500 meters around oil depots, liquefied petroleum gas stations, gas stations and warehouses that produce, store and use inflammable and explosive articles;

(three) the area within 500 meters around the ancient buildings;

(four) the area within 500 meters around high-voltage lines and important communication lines. Article 5 The relevant units within the scope of Items (2), (3) and (4) of Article 4 of these Provisions shall set up obvious signs prohibiting release. Article 6 No unit or individual may produce, process, store or carry fireworks and firecrackers in areas where the sale and discharge of fireworks and firecrackers are prohibited. Seventh vehicles transporting fireworks and firecrackers through this city must be examined by the public security organs of this city, and the dangerous goods signs must be hoisted before they can pass. Eighth major national celebrations need to set off fireworks, decided by the Municipal People's government, and issued an announcement. Ninth in the area where the sale and discharge of fireworks are prohibited, any of the following acts shall be punished by the public security organs. If the circumstances are serious, they shall be detained for not more than fifteen days.

(1) Where a unit sets off fireworks and firecrackers, it shall be fined from 1000 yuan to 5,000 yuan, and the person directly responsible for the unit and the person in charge shall be fined from 500 yuan to 1000 yuan respectively;

(two) personal fireworks, a fine of 65438 yuan in 500 yuan;

(3) Those who carry fireworks and firecrackers shall be confiscated;

(four) the production, processing, storage and transportation of fireworks, all fireworks and illegal income, and impose a fine of more than 5000 yuan 10000 yuan.

All fines and confiscations shall be turned over to the state treasury. Tenth minors in violation of these provisions, their guardians shall bear the responsibility and be responsible for compensation. Eleventh in violation of the relevant provisions of public security management, the public security organs shall be punished in accordance with the "Regulations of the people's Republic of China on administrative penalties for public security". Causing losses to state or collective property; Citizens who suffer personal or property damage shall be liable for compensation according to law; If a crime is constituted, criminal responsibility shall be investigated according to law. Article 12 When a public security organ punishes a party in accordance with these Provisions, it shall make a penalty decision and serve it on the person to be punished. If the punished person refuses to accept the punishment decision, it shall be handled in accordance with the relevant provisions of the Regulations on Administrative Reconsideration. Thirteenth of the illegal sale and discharge of fireworks, any unit or individual has the right to stop, do not listen to discourage, you can report to the public security organs, take revenge on informants, will be punished according to law. Fourteenth these Provisions shall be interpreted by the Municipal Public Security Bureau. Article 15 These Provisions shall come into force as of 1 April, 19961day.
