Should China Construction Eighth Bureau seriously investigate and deal with the wage arrears of migrant workers?

The problem of unpaid wages in the construction industry has a long history, and I have seen many workers complain. However, due to the subcontracting problem in the construction industry, it is also a difficult problem to ask for salary.

Workers didn't get their wages, so they had to ask the contractor for it. The contractor also said that they didn't get the money, so they had to ask the subcontractor for it. The subcontractor also said that the contractor's project payment was not in place, so you pushed me and I pushed you. Where are our workers' wages? Who should I ask for my salary?

In order to solve these problems and better protect the rights and interests of migrant workers, the wage guarantee for migrant workers came into being.

It is stipulated that before the project starts, the administrative department in charge of examination and approval of construction projects shall be responsible for notifying and urging the construction unit to deposit special wage funds into the bank account according to 3% of the contract price of the project. Margin in accordance with the provincial, city and county level three project approval authority to implement hierarchical supervision, the implementation of special storage, special withdrawal, no unit or individual may misappropriate.

When the construction enterprise is in arrears with wages, this money is the protection of our workers, which can effectively prevent malicious arrears. Therefore, every enterprise should store the wage deposit of migrant workers in accordance with relevant regulations.

Recently, China Construction Eighth Bureau Co., Ltd. was given administrative punishment, which was related to the wage guarantee for migrant workers. The specific reasons for the punishment are:

1, the labor cost allocation period is not stipulated in the construction contract;

2 did not open and use the special account for the wages of migrant workers;

3. Failing to store the wage margin of migrant workers according to the regulations;

4. Failing to supervise the labor, employment and salary payment of the subcontractor Henan Fangyuan Construction Co., Ltd. as required;

5. No information about the wage payment of 35 migrant workers such as Liu Guangpo was provided.

After being ordered to make corrections within a time limit, the relevant units still fail to make corrections within the time limit, and refuse to carry out the labor security supervision rectification instructions within a time limit, the China Construction Eighth Bureau respectively imposed administrative penalties of 60,000 yuan, 60,000 yuan, 60,000 yuan and 5,000 yuan, with a total fine of 6.5438 yuan +0.85 million yuan.

The wage guarantee for migrant workers is not only conducive to preventing the problem of wage arrears from the source, but also conducive to timely and properly solving the problem of wage arrears for migrant workers. Therefore, I hope that the relevant units can strictly enforce it and protect the legitimate rights and interests of workers, and I hope that wages will not be defaulted again.

In view of the wage guarantee for migrant workers, seven departments, including the Henan Provincial Department of Human Resources and Social Security, recently jointly issued the Measures for the Implementation of the Wage Guarantee for Migrant Workers in the Field of Engineering Construction in Henan Province (hereinafter referred to as the "Implementation Measures"), clarifying that the wage guarantee for migrant workers shall be paid by the general contracting enterprise, and the construction unit will no longer pay it.
