The State Council’s “Fifteen Hard Measures” for Production Safety

The first is to strictly implement the safety production responsibilities of local party committees;

The second is to strictly implement the safety production responsibilities of governments at all levels production responsibility;

The fourth is to seriously investigate leadership and supervisory responsibilities;

Eleventh, resolutely rectify the problem of lax and soft law enforcement inspections. Enforcement of safety production must not be selective and precise enforcement must be strengthened.

The twelfth step is to strengthen the construction of safety production supervision and law enforcement teams. Law enforcement responsibilities must not be delegated to different levels in the name of reform.

Thirteenth is to provide heavy rewards to encourage reports on production safety.

The fourteenth step is to seriously investigate and deal with the concealment, false reporting, late reporting and omission of production safety accidents.

The fifteenth is to coordinate economic development, safety production and epidemic prevention and control, and properly handle the relationship between red lights, green lights and yellow lights.

Legal Basis

"Production Safety Law of the People's Republic of China"

Article 118 General accidents related to production safety stipulated in this law The classification standards for major accidents, major accidents and particularly major accidents shall be stipulated by the State Council.

The emergency management department of the State Council and other departments responsible for the supervision and management of work safety shall formulate standards for the identification of major hazard sources in relevant industries and fields and the determination of major accident hazards based on their respective divisions of responsibilities.

Article 113: If a production and business operation unit has any of the following circumstances, the department responsible for the supervision and management of production safety shall request the local people's government to close it down, and the relevant departments shall revoke its relevant certificates and licenses in accordance with the law. The main person in charge of a production and business operation unit shall not serve as the main person in charge of any production and business unit within five years; in serious cases, he shall not serve as the main person in charge of a production and business unit in the industry for life:

(1) There is a potential for major accidents , is subject to administrative penalties stipulated in this Law three times within one hundred and eighty days or four times within one year;

(2) After suspending production and business for rectification, it still does not meet the requirements of laws, administrative regulations, national standards or industry standards (3) Failure to meet the safe production conditions stipulated in laws, administrative regulations, national standards or industry standards, resulting in major or particularly major production safety accidents;

(4) Refusing to implement the decision to suspend production and business for rectification made by the department responsible for the supervision and management of production safety.
