Measures for law enforcement of urban management

Chapter I General Provisions Article 1 These Measures are formulated in accordance with the Administrative Punishment Law of the People's Republic of China and relevant laws and regulations, as well as the Reply of the Legislative Affairs Office of the State Council on the Pilot Work of Comprehensive Law Enforcement of Urban Management in Changsha City, Hunan Province, in combination with the actual situation of this Municipality.

Article 2 These Measures shall apply to the urban areas of Changsha.

Third Changsha Municipal People's government comprehensive law enforcement agencies responsible for the city's urban management comprehensive law enforcement management and the organization and implementation of these measures. City, district urban management comprehensive law enforcement organs (hereinafter referred to as comprehensive law enforcement organs), in accordance with the responsibilities and division of labor stipulated by the Municipal People's government, focus on exercising the power of administrative punishment granted according to law within their respective jurisdictions, investigate and deal with illegal acts, and bear legal responsibility for specific administrative acts made.

Article 4 The urban management detachment of Changsha Municipal Public Security Bureau shall cooperate with comprehensive law enforcement agencies to do a good job in comprehensive law enforcement of urban management.

Article 5 After the power of administrative punishment is relatively centralized, the original relevant administrative law enforcement departments may no longer exercise the power of administrative punishment that has been centralized by comprehensive law enforcement organs; If it is still exercised, the decision on administrative punishment made is invalid. The relevant administrative departments of the city and district shall cooperate with the activities of comprehensive law enforcement organs to perform their duties according to law.

Sixth comprehensive law enforcement agencies should take the initiative to accept the supervision of NPC, CPPCC and public opinion. The administrative law enforcement work of the municipal and district comprehensive law enforcement organs shall be supervised by the legal department of the people's government at the corresponding level.

Article 7 Comprehensive law enforcement agencies shall establish a system of regular exchange and rotation of law enforcement personnel, implement the responsibility system for administrative law enforcement and the appraisal system, and improve the level of administrative law enforcement.

Chapter II City Appearance and Environmental Sanitation Management

Article 8 Anyone who commits one of the following acts shall be ordered to correct the illegal act, take remedial measures, and may be given a warning and a fine:

(a) spitting, urinating, splashing water, littering with peels, scraps of paper, lunch boxes, cigarette butts and other wastes shall be fined from 5 yuan to 20 yuan; Setting off firecrackers and littering with scraps of paper affect environmental sanitation, and impose a fine of more than 2,000 yuan in 20 yuan;

(II) in the building (structure) building facilities and trunks, poles graffiti and unauthorized posting, hanging promotional materials, shall be ordered to clear within a time limit, and impose a fine of more than 20 yuan and less than 200 yuan; Refuse to clear, suspend the use of communication tools for illegal activities, and may be fined up to 3000 yuan;

(III) In the balcony and window of a street frontage building specified by the Municipal People's Government, if articles that hinder the appearance of the city are stacked or hung, a fine of more than 20 yuan and less than 200 yuan shall be imposed;

(four) failing to dump garbage and feces in accordance with the regulations, a fine of more than 50 yuan and less than 500 yuan, and a fine of more than 2,000 yuan per cubic meter of 500 yuan;

(5) Failing to perform the cleaning responsibility, failing to meet the requirements, failing to remove and treat garbage, dregs and feces according to the regulations, which affects environmental sanitation, and imposing a fine of more than 100 yuan and less than 1000 yuan;

(six) transportation of bulk, fluid goods or garbage flying or muddy wheels polluting roads, affecting environmental sanitation, a fine of more than 2000 yuan in 200 yuan;

(VII) Street-facing construction sites are not provided with guardrails or shelters, the shutdown site is not arranged in time and covered as required, or the site is not cleaned and leveled in time after completion, which affects the city appearance and environmental sanitation, and a fine of more than 2,000 yuan is imposed on 200 yuan;

(8) Failing to remove the remaining (silt) mud, branches and leaves, dregs and deposits in time by erecting poles, digging and maintaining roads, pruning flowers and trees, dredging ditches, maintaining or laying pipe networks, etc., and imposing a fine of 200 yuan 1000 yuan. Ninth unauthorized feeding of livestock and poultry, affecting the city appearance and environmental sanitation, shall be ordered to deal with or be confiscated, and may be fined from 50 yuan to 200 yuan.

Tenth dogs excrete feces outdoors, and the dog owner fails to immediately remove the impact on environmental sanitation, and shall be ordered to make corrections, and may be fined from 50 yuan to 500 yuan.

Eleventh unauthorized removal of environmental sanitation facilities, or not according to the approved demolition plan, shall be ordered to stop the illegal behavior, take other remedial measures, and may be fined more than 2000 yuan in 200 yuan.

Twelfth damage to all kinds of environmental facilities and ancillary facilities, shall be ordered to restore to the original state, and may impose a fine of 100 yuan to 1000 yuan.

Thirteenth unauthorized setting of motor vehicle cleaning points, confiscate all business tools, and impose a fine of more than 2,000 yuan in 200 yuan on the car washing operators, among which, the driver of the washed vehicle shall be fined 100 yuan.

Fourteenth unauthorized establishment of livestock slaughterhouses, dismantle, overdue demolition should be forced to dismantle, and can be fined more than 2000 yuan in 200 yuan.

Fifteenth illegal scaffolding (including awnings) on both sides of urban primary and secondary roads, offenders will be removed, and impose a fine of more than 2000 yuan in 200 yuan. On both sides of the road frontage buildings (structures), facilities and scaffolding, sunshade (rain) cloth, canopy damage, pollution, affecting the city appearance, ordered the relevant units and individuals to transform or dismantle; Overdue renovation or demolition, forced demolition, and may be fined more than 2000 yuan in 200 yuan.

Sixteenth outdoor advertisements, neon lights, electronic display screens, placards, street signs, galleries, windows, posters, etc. Damaged or outdated content, not timely replacement, maintenance or removal, and ordered the relevant units and individuals to transform or remove within a time limit; Overdue renovation or demolition, forced demolition, and may be fined more than 2000 yuan in 200 yuan.

The scope of the power of administrative punishment for urban management law enforcement is determined according to laws and regulations and the relevant provisions of the State Council, including the power of administrative punishment stipulated by laws and regulations in the field of housing and urban construction, as well as the power of administrative punishment related to urban management in environmental protection management, industrial and commercial management, traffic management, water management and food and drug supervision.

2, the need to focus on the exercise of urban management law enforcement matters, should also meet the following conditions:

(a) closely related to urban management;

(three) high frequency of law enforcement and corresponding professional and technical requirements;

Article 1 These Measures are formulated in accordance with the provisions of the Administrative Punishment Law, the Administrative Enforcement Law and other laws and regulations in order to standardize the law enforcement of urban management, improve the level of law enforcement and service, maintain the order of urban management and protect the legitimate rights and interests of citizens, legal persons and other organizations.

These Measures shall apply to the urban management law enforcement activities and law enforcement supervision activities in the built-up area of the town where the people's governments of Nijo Castle City and County are located.

The term "urban management law enforcement" as mentioned in these Measures refers to the behavior of the competent department of urban management law enforcement in performing administrative law enforcement duties such as administrative punishment and administrative enforcement in the field of urban management according to laws, regulations and rules.

Article 3 Urban management law enforcement shall follow the principles of people-oriented, governance according to law, governance at the source, consistency of powers and responsibilities, and coordination and innovation, and adhere to strict, standardized, fair and civilized law enforcement.

Article 4 The competent department of housing and urban and rural construction in the State Council shall be responsible for the guidance, supervision and coordination of urban management law enforcement throughout the country.

The competent departments of housing and urban construction of the people's governments of all provinces and autonomous regions shall be responsible for the guidance, supervision, inspection and coordination of urban management law enforcement within their respective administrative areas.

The competent department of urban management law enforcement of the people's governments of cities and counties shall be responsible for the urban management law enforcement within their respective administrative areas.

Fifth urban management law enforcement departments should promote the establishment of urban management coordination mechanism and coordinate relevant departments to do a good job in urban management law enforcement.

Sixth urban management law enforcement departments should strengthen the publicity and popularization of urban management laws, regulations and rules, enhance the awareness of the whole people to abide by the law, and maintain the order of urban management.

Seventh urban management law enforcement departments should actively provide conditions for the public to supervise urban management law enforcement activities.
