chapter I general provisions article 1 these regulations are formulated in accordance with the law of the people's Republic of China on the prevention and control of environmental pollution by solid waste and relevant laws and administrative regulations, and in combination with the actual situation of this municipality, in order to standardize rural garbage management, improve rural living environment and promote the construction of beautiful countryside. Article 2 These Regulations shall apply to activities such as cleaning, classification, delivery, collection, transportation, disposal, supervision and management of rural garbage within the administrative area of this Municipality.

the term "rural garbage" as mentioned in these regulations refers to the solid waste generated in rural production, living and construction activities in urban built-up areas, town built-up areas where county people's governments are located and other areas outside urbanization management areas.

if there are provisions in laws, regulations and departmental rules on the management of industrial solid wastes, hazardous wastes and other solid wastes, those provisions shall prevail. Article 3 The treatment of rural garbage shall follow the principles of government leading, social participation, graded responsibility, overall promotion, source treatment and comprehensive utilization.

Article 4 The people's governments of cities and counties (districts) shall incorporate rural garbage treatment into the national economic and social development plan, and adopt economic and technical policies and measures conducive to rural garbage treatment.

the people's governments of counties (districts) and townships (towns) should include the expenses of rural garbage treatment in the annual budget, and basically guarantee the needs of rural garbage treatment. The Municipal People's Government shall provide financial support. Fifth city and county (District) people's government housing and urban and rural construction administrative departments responsible for the administrative area of rural garbage management.

the management institutions of development zones and scenic spots undertake the rural garbage control work in the areas designated by the people's governments of cities and counties (districts).

urban and rural planning, land and resources, urban management, environmental protection, finance, development and reform (price), commerce, education, agriculture, health and other departments should do a good job in rural garbage control according to the division of responsibilities. Sixth township (town) people's government, street offices to do a good job in rural garbage collection, transfer facilities construction and daily operation management, supervision and guidance of the village (community) garbage cleaning, classification, delivery, collection, transportation and other work.

Article 8 Conditional counties (districts) and townships (towns) shall explore the establishment of a rural garbage control fund investment mechanism combining voluntary payment by villagers (residents), village (residents) collective subsidies and financial subsidies.

the village (community) can raise funds for the daily cleaning of the village (community) through "one thing, one discussion".

units and individuals engaged in production and operation shall pay garbage disposal fees. Article 9 The government and its functional departments, sub-district offices, village (neighborhood) committees, and mass organizations such as trade unions, women's federations and * * * youth groups shall carry out publicity and education activities on rural garbage control.

Radio and television stations, newspapers, periodicals, internet and other media should strengthen the publicity of garbage control and publish a certain proportion of public service advertisements on garbage control. Tenth city and county (District) people's governments shall establish and improve the supervision mechanism and comprehensive evaluation system of rural garbage management, and incorporate them into the government performance evaluation system. Eleventh any unit or individual has the right to dissuade, complain and report violations of these regulations.

the administrative departments of housing and urban and rural construction of the people's governments of cities and counties (districts) shall establish a complaint reporting system, and publish telephone numbers, mailboxes and e-mails for reporting complaints. The administrative department of housing and urban and rural construction shall, after receiving the report, deal with it within fifteen days, and feed back the result to the reporter. For those who are not within the scope of their functions and powers, they shall be promptly transferred to relevant departments for handling, and the transfer shall be reported to the informants. Relevant departments should deal with it in a timely manner and feed back the results to the administrative departments of housing and urban and rural construction. Chapter II Special Planning and Facilities Construction Article 12 The administrative department of housing and urban and rural construction of the county (district) people's government shall, jointly with the departments of urban and rural planning, urban management, development and reform, environmental protection, agriculture, land and resources of the county (district), organize the preparation of special plans for rural garbage control, and report them to the county (district) people's government for approval before implementation.

the opinions of relevant departments, experts and the public should be solicited when making a special plan for rural garbage control. Thirteenth rural garbage disposal special planning should be based on the regional area, garbage production, garbage classification requirements and other reasonable settings of garbage transfer stations and garbage disposal facilities, places; Facilities and places for the storage, consumption and comprehensive utilization of rural construction waste and crop straw should be set up separately.

the county (district) people's government shall incorporate the construction land and construction plan of rural garbage disposal facilities and places into the annual land use plan and the annual implementation plan of urban and rural planning. Article 14 The location of rural garbage transfer stations shall meet the following requirements:

(1) It shall meet the requirements of the overall planning of townships (towns), the professional planning of environmental sanitation and the relevant national standards;

(2) Reasonable layout according to the principle of regional overall planning and township (town) overall planning;

(3) The transportation is convenient and it is easy to arrange garbage collection and transportation routes; The roads in and out of the garbage transfer station meet the traffic requirements of garbage collection and transportation vehicles;

(4) having reliable power supply, water supply source and sewage discharge collection or treatment system;

(5) The sanitary protection distance between the pollution discharge point of the transfer station and the surrounding sensitive areas (points) such as hospitals, schools and residential areas shall not be less than 5m; If it cannot be met due to the conditions, necessary isolation and protective measures shall be taken.
