Township (town) people's governments and sub-district offices shall, in accordance with the work arrangements of the people's governments at higher levels and relevant departments, do a good job in the prevention and control of air pollution. Article 6 Encourage and support the research and popularization of new technologies, new processes and new equipment for the prevention and control of air pollution. Article 7 All units and individuals have the obligation to protect the atmospheric environment, and should consciously adopt a green and economical way of production, life and consumption, reduce the emission of atmospheric pollutants and improve the quality of the atmospheric environment.
Actively advocate the public and social groups to participate in air pollution prevention and public welfare activities. Chapter II Supervision and Management Article 8 People's governments at all levels should change the mode of economic development, adjust the energy structure and industrial structure, promote circular economy and clean production, improve the greening rate and forest coverage rate, promote green transportation and green buildings, and reduce the generation and discharge of air pollutants from the source.
The people's governments at or above the county level shall, according to the natural conditions, geographical characteristics and planning development direction of their respective administrative areas, determine the urban functional orientation and air quality control indicators. Article 9 The provincial people's government may, according to the atmospheric environmental quality and economic and technical conditions, formulate atmospheric environmental quality standards, air pollutant emission standards and coal quality standards that are stricter than the national standards, and may expand the scope of implementation of special emission limits for air pollutants.
The provincial people's government shall regularly organize relevant departments, industry associations and experts to evaluate the standards stipulated in the preceding paragraph, and make timely revisions according to the evaluation results. When evaluating and revising, public opinions shall be solicited, and the evaluated and revised standards shall be announced to the public in a timely manner. Article 10 The provincial people's government shall, according to the needs of air pollution prevention and control, determine the types and total emission of key air pollutants, and decompose the total emission control indicators of key air pollutants step by step and implement them to the people's governments of cities and counties (cities, districts) with districts.
The total emission control indicators of key air pollutants of pollutant discharge units shall be approved by the competent environmental protection department of the people's government at or above the county level according to the total emission control indicators of key air pollutants in their respective administrative areas, the existing emissions of pollutant discharge units and the need to improve the quality of the atmospheric environment. Eleventh enterprises, institutions and other producers and operators to discharge atmospheric pollutants, shall not exceed the national and provincial emission standards, shall not exceed the approved key air pollutant total control indicators. Article 12 The competent department of economy and informatization of the provincial people's government shall, jointly with the relevant departments, regularly formulate and adjust the elimination list of production processes, equipment and products that seriously pollute the atmospheric environment, and submit it to the provincial people's government for approval before promulgation and implementation.
Enterprises, institutions and other producers and operators shall eliminate the production processes, equipment and products listed in the preceding paragraph within the prescribed time limit. Thirteenth construction projects should be carried out in accordance with the law of environmental impact assessment. The environmental impact assessment document shall not be started without the approval of the competent department of environmental protection of the people's government at or above the county level.
For construction projects that discharge key air pollutants, the competent department of environmental protection shall, when examining and approving the environmental impact assessment documents, verify the total emission index of key air pollutants.
If the construction project may have a significant impact on the atmospheric environment in the adjacent area, the competent department of environmental protection shall solicit the opinions of the competent department of environmental protection at the same level in the adjacent area when examining and approving its environmental impact report; If there are differences, the competent department of environmental protection of the people's government at a higher level shall handle them. Article 14 The competent department of environmental protection of the provincial people's government shall establish an atmospheric environment investigation and monitoring system, and improve the atmospheric environment quality and pollution source monitoring system.
The setting of automatic atmospheric environmental monitoring stations shall meet the requirements of monitoring technical specifications, and shall not be changed, adjusted or cancelled without approval. Fifteenth units that discharge industrial waste gas or toxic and harmful air pollutants shall set up monitoring points and sampling monitoring platforms in accordance with the regulations and monitoring norms, and monitor themselves or entrust units with corresponding qualifications to monitor. The original monitoring records shall be kept for not less than three years.
Key pollutant discharge units shall install automatic monitoring equipment for air pollutant discharge in accordance with relevant technical specifications, and connect with the monitoring system of the competent environmental protection department of the people's government at or above the county level to ensure the normal operation of the monitoring equipment, and be responsible for the authenticity and accuracy of the monitoring data.
