On March 1 this year, the "Shenzhen Special Economic Zone Urban Renewal Regulations" implemented and created the "individual expropriation and administrative litigation" system, and also required our city to formulate specific measures for the expropriation of uncontracted houses. According to the "Regulations on Housing Expropriation and Compensation on State-owned Land" (State Council Order No. 590), "Shenzhen Special Economic Zone Urban Renewal Regulations" (hereinafter referred to as the "Renewal Regulations") and "Shenzhen Municipal Housing Expropriation and Compensation Implementation Measures (Trial)" (Shenzhen Municipal People's Government Order No. 292) and other relevant regulations, the Municipal Planning and Natural Resources Bureau has drafted the "Shenzhen Urban Renewal Provisions on the Expropriation of Uncontracted Parts of Houses (Draft for Comments)" in response to the expropriation of uncontracted parts of houses for urban renewal projects.

According to the "Regulations", our city will establish a two-way communication mechanism for the basic situation of urban renewal projects. In order to avoid insufficient information exchange, causing the relocation compensation agreement signed by market entities and property rights holders to conflict with the housing expropriation decision made by the district government, the "Regulations" set up a notice procedure for the housing expropriation decision. That is, if the district government approves the implementation of house expropriation, it should issue a notice of the house expropriation decision, and the notice period is 10 working days; during the notice period, if the market entity signs a relocation compensation agreement with the property owner, the district government must be informed before the notice period expires.

In addition, the "Regulations" also implement and refine the provisions of Article 38 of the "Renewal Regulations" and clarify the conditions for the termination of the expropriation process for the uncontracted parts of urban renewal. That is, if the market entity signs a relocation compensation agreement with the property owner, the district government should be notified before the house expropriation decision takes effect, and the district government will promptly terminate the house expropriation process.

It is reported that after the "Regulations" are officially released, they will be connected with the city's existing housing expropriation-related policies.
