Regulations of Xuzhou Municipality on Waterway Management

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Regulations of the People's Republic of China on Waterway Management and in the light of the actual situation of this Municipality in order to strengthen waterway management and ensure the safety of navigation and smooth navigation. Article 2 Units and individuals engaged in the planning, construction, protection and management of navigation channels and navigation facilities within the administrative area of this Municipality shall abide by these Regulations. Article 3 The traffic administrative department of the city, county (city) and jiawang district Municipal People's Government (hereinafter referred to as the waterway administrative department) shall be in charge of the waterway management within their respective administrative areas.

Development planning, planning, water conservancy, land and resources, public security and other relevant administrative departments shall, in accordance with their respective responsibilities, do a good job in waterway management. Article 4 The people's governments of cities, counties (cities) and jiawang district shall incorporate waterway construction into the national economic and social development plan to promote the development of waterway undertakings. Chapter II Planning and Construction Article 5 The municipal waterway management department shall, in accordance with the principle of overall planning and comprehensive utilization, formulate waterway planning within its administrative area in combination with water resources-related professional planning, and implement it after approval in accordance with the authority of waterway planning management. Article 7 The municipal waterway management department shall, according to the navigation standards, flood control standards and the needs of shipping development, formulate the technical grade of the waterway, which shall be used as the basis for waterway management and determination of river-crossing facilities, ships, buildings and waterway construction standards after being approved according to the management authority of the technical grade of the waterway. Chapter III Protection and Management Article 8 The waterway management department shall do a good job in monitoring and maintaining the waterway and waterway facilities to ensure that the waterway and waterway facilities are in good condition.

No unit or individual may illegally interfere with or obstruct the surveying, dredging, mud throwing, reclamation, obstacle clearing, bed sweeping and other activities for the maintenance of navigation channels and navigation channel facilities, or ask for fees from them; Damage caused by land occupation and deforestation shall be compensated according to law.

During waterway maintenance and construction, signs should be set up at the construction site. Article 9 Commercial dredging, obstacle clearing and salvage operations related to navigation, dredging, obstacle clearing and salvage operations shall not pollute the surrounding environment, and shall not be abandoned within 65,438+00 meters of navigation channel, navigation channel slope and navigation channel bank slope, and shall be cleared and transported to the designated place. Article 11 The waterway management department shall timely issue waterway notices such as waterway change, navigation mark movement, waterway scale, waterway and lock construction. The construction and management of greening on both sides of the twelfth waterway shall be organized and implemented by the ownership unit. Article 13 New construction, reconstruction and expansion of riverside, river-crossing and river-crossing facilities related to navigation shall conform to the requirements of the technical level of the waterway as stipulated in Article 14, and shall be reported to the waterway management agency for approval.

The construction unit or individual shall provide the following materials when applying for approval to the waterway management department:

(a) the application of the construction unit or individual;

Waterway plan of the location of the facility;

(3) Location of facilities in the waterway section;

General layout of facilities.

The waterway management institution shall, within 20 days from the date of receiving the materials mentioned in the preceding paragraph, make a review, and make a written approval decision if it meets the conditions and standards; If an administrative license is not granted, it shall inform the applicant in writing and explain the reasons.

The construction unit or individual shall start construction within one year from the date of approval. If construction cannot be started, the license extension formalities shall be handled according to law. If the construction fails to start within the time limit and the license renewal formalities are not handled, the approval document of the license shall be revoked by the waterway management department according to law. Article 14 The construction of river-facing, river-crossing and river-crossing facilities related to navigation shall meet the following requirements:

(a) the bridge across the waterway shall comply with the provisions of the national inland waterway shipping standards; The wires (cables) crossing the waterway shall meet the requirements of the clear height scale of overhead power and telecommunication lines crossing the river in Jiangsu Province;

(2) Set up revetment, ferry, pumping (discharging) water station (well) and water level observation well outside navigable waters, and the lateral velocity of pumping (discharging) water flow shall not be greater than 0.3m/s;

(3) The wharf shall be located in the straight section of the waterway, without affecting the original navigation conditions, and meet the following standards:

1. The distance from the fairway interchange shall not be less than the length of the standard fleet of fairway grades, and the distance from the bridge shall not be less than100m;

2. The minimum distance between the wharf front and the center line of the waterway shall not be less than Class II navigation.

The road is 75.5 meters, the third channel is 70 meters, the fourth channel is 60 meters, the fifth channel is 50 meters, and the channel below the sixth level is 40 meters;

3. The length of the wharf must ensure that ships with corresponding channel grade standards can directly dock and have room for manoeuvre;

4. The distance between adjacent wharves of the second-class channel is not less than 100 m, the third-class channel is not less than 90 m, the fourth-class channel is not less than 70 m, the fifth-class channel is not less than 60 m, and the channel below level 6 is not less than 40 m;

(4) The buried depth of the pipeline at the bottom of the river is: the channel above Grade V shall be 2m lower than the planned river bottom elevation, and the channel below Grade VI shall be 2m lower than the planned river bottom elevation1m. If the actual river bottom elevation is lower than the planned river bottom elevation, the actual river bottom elevation shall prevail.
