Interim Provisions of Chengdu Municipality on the Administration of Outdoor Advertisements and Signboards

Chapter I General Provisions Article 1 In order to regulate the planning and management of outdoor advertisements and signboards, these Provisions are formulated in accordance with the Advertising Law of People's Republic of China (PRC), the Urban Planning Law of People's Republic of China (PRC), the Regulations of the State Council on the Administration of City Appearance and Environmental Sanitation and other laws and regulations, combined with the actual situation in Chengdu. Article 2 These Provisions shall apply to the management of outdoor advertisements and signboards and related activities within the outer ring road of this Municipality (including 500m outside the outer ring road) and within the airport expressway. Article 3 The term "outdoor advertisement setting" as mentioned in these Provisions refers to the act of setting, posting and hanging outdoor advertisements in public places and buildings (structures) such as roads, squares, green spaces, airports, stations, docks, waters, etc. by using words, images, physical modeling, gas fillers and other forms of expression. The term "signboard setting" as mentioned in these Provisions refers to the act of setting up signs, signs, light boxes, neon lights and font symbols used to express names on buildings or facilities in business (office) places. Article 4 The setting of outdoor advertisements and signboards shall conform to the urban planning and the requirements of beautifying the city, and shall not affect the urban landscape. Article 5 The municipal administrative department of city appearance and environment shall be responsible for the supervision and management of outdoor advertisements and signboards in this Municipality. Planning, industry and commerce, construction, transportation, tourism, gardens, municipal utilities, urban management administrative law enforcement and other relevant departments shall, according to their respective responsibilities, coordinate the implementation of these Provisions. Chapter II Outdoor Advertising Planning Article 6 The municipal planning administrative department shall, jointly with the relevant departments of city appearance, industry and commerce, transportation, etc. Formulate outdoor advertising planning, and organize the implementation after the approval of the Municipal People's government. Outdoor advertising planning should be divided into setting areas and forbidden setting areas. No outdoor advertisements in any form shall be set up in the forbidden area. Seventh in any of the following circumstances in the outdoor advertising area, outdoor advertising shall not be set up:

(1) Construction control zones of state organs, military organs, cultural relics protection units and scenic spots;

Using traffic safety facilities and traffic signs;

(three) affecting the use of municipal public facilities, traffic safety facilities and traffic signs;

4, hinder production or people's lives;

(five) may endanger the safety of buildings (structures);

Use street trees or damage green space;

(seven) damage the appearance of the city. Article 8 The setting of outdoor advertisements shall meet the following requirements:

(a) the design, manufacture and installation of outdoor advertising facilities shall conform to the corresponding technical and quality standards;

Does not affect the ventilation and lighting of adjacent units or households;

(3) The hanging distance of the hanging outdoor billboard shall not exceed 3m and the red line of the road, and the clearance height of the bottom edge from the ground shall not be less than 3m and the height shall not exceed the roof of the building;

(four) set up roof advertisements, the height is not more than 6 meters, and the width is not more than the walls on both sides of the building;

(five) set up a column advertising tower, the distance between the airport expressway and other roads in and out of the city is not less than 800 meters, and the distance between them is not less than 1000 meters. In addition to the airport expressway, no column advertising tower shall be set up within the Third Ring Road (excluding the Third Ring Road);

(six) according to the provisions of the configuration of night light sources, but the lighting facilities shall not be similar to road traffic signs and signals. Chapter III Management of Outdoor Advertising Facilities Article 9 The establishment of outdoor advertising shall obtain the right to occupy outdoor advertising space resources. Outdoor advertising space resources are franchised by the government. In principle, the right to use outdoor advertising space resources is obtained by auction, and the specific measures shall be formulated separately by the municipal administrative department of city appearance and environment and implemented after approval by the Municipal People's government. Article 10 Where rooftop advertising facilities or advertising structures are set up, a planning permit for the construction of outdoor advertising facilities issued by the municipal planning administrative department shall be obtained. When applying for a construction project planning permit, the applicant shall submit the following documents to the municipal planning administrative department:

(1) An application form for setting up outdoor advertising facilities;

(2) Proof of occupancy right of outdoor advertising space resources;

(3) Construction drawings of outdoor advertising facilities;

Outdoor advertising facilities street facade renderings;

Other documents required by the planning administrative department. Article 11 The municipal planning administrative department shall examine the applicant's application within 10 working days from the date of receiving the application. To meet the requirements, the issuance of outdoor advertising facilities "construction planning permit", and send a copy to the municipal administrative department of city appearance and environment for the record; Do not meet the conditions, it shall explain the reasons in writing. The applicant who applies for the Construction Project Planning Permit shall pay the construction application fee as required. Twelfth outdoor advertising facilities shall be set in accordance with the approved location, form and specifications, and shall not be changed without authorization; If it is really necessary to change, it shall go through the formalities of change in accordance with the application setting procedures within 30 days after approval. Thirteenth after the completion of the construction of outdoor advertising facilities, it must be accepted, and within 05 days after the acceptance, the acceptance information will be reported to the municipal planning administrative department for the record. Fourteenth after the completion of outdoor advertising facilities, the setters can use them themselves, or transfer the right to use them according to law through leasing or paid transfer, except those prohibited by laws and regulations; Transferred according to law, the transferee shall, within 30 days after the transferee, go to the municipal planning administrative department for the record. Outdoor advertising facilities that have passed the acceptance inspection shall not be idle for more than 5 days, and public service advertisements shall be covered during the idle period. To set up outdoor advertisements on outdoor advertising facilities, the outdoor advertisement registration certificate must be obtained in accordance with the requirements of Chapter IV of these Provisions.
