Notice of Fengxiang District People's Government of Baoji Municipality on Prohibiting and Restricting the Setting off of Fireworks and Firecrackers

In order to prevent and control air pollution, protect and improve the atmospheric environment, and prevent and reduce unsafe accidents caused by fireworks and firecrackers, according to the Regulations on the Safety Management of Fireworks and Firecrackers in the State Council, the Regulations on the Prevention and Control of Air Pollution in Shaanxi Province and the Regulations on the Safety Management of Fireworks and Firecrackers Sales in Baoji City, combined with the actual situation in our region, we hereby notify you of the prohibition and restriction of fireworks and firecrackers in our region as follows:

Article 1 Fireworks and firecrackers are prohibited throughout the year.

(1) State organs, military stations, schools, kindergartens, hospitals, museums, libraries and archives; ② Stations, squares, parks, parking lots, shopping malls, hotels, theaters, stadiums, Internet cafes, entertainment places and other crowded areas; ③ Urban underground space; ④ Surrounding areas of gas stations, liquefied gas stations, natural gas stations, filling stations, gas pipe networks and their supporting facilities; (5) Warehouses, substations, places where inflammable and explosive articles are produced, stored, sold and used and their surroundings; 6 cultural relics protection units and tourist attractions; ⑦ Residential quarter; (8) Chengguan Town, Chencun Town, Changqing Town and Liulin Town of Fengxiang High-tech Zone. Pet-name ruby District People's Government issued a three-level warning for heavy polluted weather, and fireworks and firecrackers were prohibited in the warning area. Attending other places where fireworks and firecrackers are strictly prohibited.

Article 2 The area and time for setting off fireworks and firecrackers shall be restricted.

In addition to the areas specified in Article 1, other areas are areas where fireworks and firecrackers are restricted. Fireworks and firecrackers are prohibited from 2023 1 October1to March 3, 20231.

Public security, ecological environment and other departments should vigorously publicize the harm of large-scale and staged fireworks and firecrackers to the environment, and vigorously advocate the use of electronic firecrackers and electronic fireworks instead of fireworks and firecrackers as holiday celebration tools.

Article 3 No unit or individual may engage in fireworks business activities without obtaining the Fireworks Business License issued by the District Administrative Examination and Approval Bureau; Without obtaining the "fireworks permit" issued by the public security department, no large-scale fireworks display activities such as fireworks parties shall be held.

Article 4 Fireworks and firecrackers shall not be thrown at pedestrians, vehicles, buildings, structures, crowded places and places where fireworks and firecrackers are prohibited, and shall not hinder the safe passage of pedestrians and vehicles and affect traffic order. It is strictly prohibited to set off or scatter fireworks and firecrackers in corridors, balconies, windows, roofs and other places of buildings, and fireworks and firecrackers shall not be set off in other ways that endanger public safety and personal and property safety.

Parents or guardians of minors shall educate and guide minors to abide by this circular.

Fifth public security, emergency management, market supervision and other departments shall, in accordance with their respective responsibilities, strengthen supervision over the sale and discharge of fireworks and firecrackers, and organize the investigation and punishment of illegal operation, storage and discharge of fireworks and firecrackers. Urban management comprehensive law enforcement units shall investigate and deal with the acts of setting up stalls and operating fireworks and firecrackers according to law.

Article 6 Where fireworks and firecrackers are set off at a time and place where they are prohibited, or in a way that endangers the public and personal and property safety, the public security organ shall, in accordance with the provisions of the second paragraph of Article 42 of the State Council's Regulations on the Safety Management of Fireworks and Firecrackers, order them to stop setting off and impose a fine of 65,438 yuan to 5,000 yuan; Those who violate the administration of public security shall be punished according to law. In the process of discouraging the illegal discharge of fireworks and firecrackers, those who hinder the staff of state organs from performing their duties according to law and hinder social management shall be detained for more than 5 days 10 days in accordance with the provisions of Article 50 of the Law of People's Republic of China (PRC) on Public Security Administration Punishment, and may also be fined less than 500 yuan;

Article 7 Where a fireworks party or other large-scale fireworks display activity is held without permission, the public security organ shall, according to the first paragraph of Article 42 of the Regulations on the Safety Management of Fireworks and Firecrackers in the State Council, order it to stop the discharge, and impose a fine of 6,543,800 yuan to 50,000 yuan on the responsible unit.

Article 8 Where fireworks and firecrackers are carried on public transport, mailed or in checked luggage, parcels and mails, the public security organs shall confiscate the illegally carried fireworks and firecrackers in accordance with the provisions of Article 41 of the Regulations on the Safety Management of Fireworks and Firecrackers in the State Council, and may impose a fine of more than 65,438 yuan+0,000 yuan on 200 yuan.

Article 9 The Town People's Government shall organize communities or villagers' committees to delimit the scope and areas where fireworks and firecrackers are prohibited, and strengthen the publicity, education and management of prohibiting and restricting fireworks and firecrackers in this area. Organs, departments, property service enterprises and other units should strengthen the publicity, education and management of prohibiting and restricting the discharge of fireworks and firecrackers for employees and residents in this area. To do a good job in news reporting, media centers in the region should increase publicity and education on environmental protection and air pollution prevention and control, advocate the general public to enhance their awareness of safety, environmental protection and civilization, and try not to set off fireworks and firecrackers as much as possible.

Tenth party and government organs at all levels, people's organizations, state-owned enterprises and institutions are strictly prohibited to use public funds to buy and set off fireworks. State functionaries and party member cadres should set an example and refuse to set off fireworks. The masses and self-employed households should establish a sense of safety, environmental protection and civilization, consciously abide by the provisions of this circular, and create a good urban public environment.

Twelfth this notice shall come into force as of the date of promulgation. If the original provisions of the district government are inconsistent with this notice, this notice shall prevail.
