Zhuhai City Safety Production Regulations

Chapter 1 General Provisions Article 1 In order to strengthen the supervision and management of production safety, prevent and reduce production safety accidents, and protect the safety of people's lives and property, in accordance with the "Work Safety Law of the People's Republic of China and the State", etc. These regulations are formulated in accordance with laws and regulations and in light of the actual situation of this city. Article 2 These regulations apply to the safety production activities of units engaged in production and business activities within the administrative region of this city (hereinafter referred to as production and business units). Article 3: Safety production work adheres to the policy of safety first, prevention first, and comprehensive management. Article 4 The municipal and district people's governments shall formulate special plans for production safety, incorporate them into the overall plan for national economic and social development, and organize their implementation.

Municipal and district people's governments should set up special funds for production safety. Special funds for production safety should be included in the fiscal budget of the government at the same level and increase year by year with the growth of fiscal revenue. Article 5 The municipal and district people's governments shall establish production safety committees as the deliberative and coordination bodies for production safety, responsible for coordinating and guiding production safety work within their respective administrative regions, and coordinating and resolving major issues in production safety. Article 6 The production safety supervision and management departments of the municipal and district people's governments (hereinafter referred to as the safety supervision departments) shall comprehensively manage production safety work within their respective administrative regions, perform production safety supervision and management functions in accordance with the law, and organize the implementation of these Regulations.

Other relevant government departments shall, within the scope of their respective responsibilities, do a good job in the supervision and management of production safety in accordance with the law. Article 7 The management committee of the economic functional zone shall formulate a special plan for production safety and set up special funds for production safety.

The administrative committee of the economic functional zone shall establish a production safety committee, establish a production safety supervision and management agency, and equip production safety supervision and management personnel to be responsible for the safety production supervision work in the area under its jurisdiction. Article 8 The town people's government and sub-district offices shall be equipped with production safety supervision and management personnel to be responsible for the supervision of production safety in the towns and sub-districts under their jurisdiction. Article 9 Production and business units are the entities responsible for production safety. Production and business units shall strengthen safety production management in accordance with the law, establish and improve safety production responsibility systems, improve safety production conditions, and ensure production safety. Article 10 People's governments at all levels and their relevant departments shall adopt various forms to strengthen the publicity of laws, regulations and safety knowledge related to production safety, and enhance the awareness of production safety and safety prevention capabilities of the whole society.

This city's newspapers, radio, television and other news media should carry out public welfare safety production publicity and education free of charge, and conduct public opinion supervision of safety production violations. Article 11 People's governments at all levels shall establish a production safety reward system to commend and reward units and individuals that have made outstanding achievements in production safety. Chapter 2 Responsibilities and Guarantees of Safety Production Article 12 The principal person in charge of a production and business unit is the first person responsible for safety production in the unit and is fully responsible for the unit’s safety production work; the person in charge of safety production is the person directly responsible for safety production , bear direct leadership responsibility for production safety work; other persons in charge shall bear leadership responsibility for production safety work within their respective business scopes. Article 13 Production and business units shall meet the following safety production conditions:

(1) The production and business premises, equipment and facilities comply with the provisions of relevant production safety laws and regulations and the requirements of mandatory standards;

(2) Establish and improve the production safety management system and formulate production safety operating procedures;

(3) Set up a production safety management organization or assign production safety management personnel;

(4) Equip employees with labor safety protective equipment that meets mandatory standards;

(5) The main person in charge and safety production management personnel have received safety production training and assessment;

( 6) Employees must receive education and training on production safety;

(7) Other production safety conditions stipulated in laws, regulations and mandatory standards.

Article 14 Production and business units shall establish the following safety production management systems:

(1) Safety production responsibility system;

(2) Safety production education and training system;

(3) Safety production reward and punishment system;

(4) Safety production archive system;

(5) Hazardous operation management system;

(6) Safety management system for production and operation sites, equipment and facilities with relatively high risk factors;

(7) Safety production inspection and hidden danger registration and rectification system;

(8) ) Labor safety protective equipment equipment and management system;

(9) Emergency rescue system;

(10) Production safety accident reporting and investigation and handling system;

(11) Other rules and regulations to ensure safe production. Article 15 Production and business units shall ensure the necessary capital investment for safe production. Mining, construction units and production and operation units in high-risk industries such as hazardous chemicals, fireworks and firecrackers, civil explosive equipment, transportation, electric power, metallurgy, etc. shall allocate safety expenses in accordance with the prescribed proportions. Safety expenses are included in production costs, stored in a special account, and used exclusively for safety production. Article 16 The production safety capital investment or safety expenses of a production and business operation unit shall be used exclusively for the following safety production matters:

(1) Construction of safety technical measures projects;

(2) ) Update and maintenance of safety equipment and facilities;

(3) Safety production publicity, education and training;

(4) Equipping of labor safety protection supplies;

(5) Monitoring and management of major hazard sources and assessment and rectification of potential accident hazards;

(6) Provision of emergency rescue equipment and supplies and accident emergency rescue drills;

(7) Other guarantees Safety production matters.
