Article 1: These regulations are formulated in order to control the harm of smoking, protect the health of citizens, protect the environment, and prevent fires. Departments of education, commerce, sports, transportation, culture, urban construction, public security and other units as well as civil aviation, railways, seaports and other units should supervise and manage the ban on smoking in public places within the system or management scope. . Article 3 Smoking is prohibited in the following places:

(1) Audience halls of theaters and concert halls, clubs, conference venues, auditoriums, video halls (rooms), entertainment halls (rooms), Internet cafes, singing (dance) Halls and music cafes (rooms);

(2) Audience halls and competition halls of indoor gymnasiums (fields) and swimming pools;

(3) Reading rooms of libraries and museums Exhibition halls such as art galleries and exhibition halls;

(4) Shops and bookstores with an area of ??more than 200 square meters;

(5) Cabins and cabins of public transportation vehicles And the waiting rooms (ships, airports), ticket halls, etc. in carriages, stations, docks, and civil airports;

(6) Waiting rooms, clinics, wards, etc. in health and medical units;

(7) Indoor activity places such as classrooms and corridors in schools at all levels and types, and children’s activity places in day care institutions;

(8) Other public places where smoking is prohibited according to national laws and regulations. ***place. Article 4 The unit where smoking is prohibited shall perform the following responsibilities:

(1) Formulate the unit's ban on smoking system and corresponding measures to supervise those who violate the relevant provisions of these regulations;

(3) Set up eye-catching no-smoking signs in various places where smoking is prohibited;

< p>(4) Smoking equipment and signs or items with tobacco advertisements shall not be installed in no-smoking places;

(5) All conditional no-smoking places must provide smokers with ventilation devices Smoking rooms (areas) with obvious signs; Article 5 State agencies, enterprises, institutions, social groups and other organizations may set specific smoking rooms (areas) for their internal meeting rooms, libraries, workshops, restaurants and other collective activity venues. As a place where smoking is prohibited, and with reference to the requirements of these regulations, we will formulate our own system and do a good job in supervision and management. Article 6 Education, culture, health, environmental protection and other departments and news units must regularly carry out publicity on the harmful effects of smoking on health.

May 31st every year is World No Tobacco Day. In addition to stopping the sale of cigarettes for one day, all units with publicity capabilities and publicity tools must actively publicize smoking control.

The industrial and commercial departments must strictly abide by the Advertising Law of the People's Republic of China, strengthen supervision and management of tobacco advertising, and investigate and deal with illegal acts of setting up tobacco advertising in public places. Article 7 In places where smoking is prohibited, passive smokers have the right to ask smokers to stop smoking; they have the right to ask their units to perform the duties of items (3), (4) and (5) of Article 4 of these regulations; they have the right to Units that fail to implement the regulations shall report their violations of these regulations to the local county (city) or district Patriotic Health Campaign Committee. Article 8 Units or individuals who violate these regulations shall be punished in accordance with the following provisions:

(1) Anyone who violates Article 3 of these regulations and smokes in a no-smoking public place shall be ordered to make corrections. Anyone who refuses to make corrections shall be fined 20 yuan;

(2) Anyone who violates Article 4 (1) or (2) of these regulations shall be given a warning and ordered to make corrections within a time limit. Article 9: Administrative penalties for violations of these regulations shall be implemented by the departments responsible for the daily work of the Patriotic Health Campaign Committee. If a fine of twenty yuan is imposed, an administrative penalty decision may be made on the spot and the fine collected. Article 10 These regulations shall come into effect on October 1, 1995.
