How to correctly understand the construction of socialist rule of law with Chinese characteristics

Adhere to the rule of law that is consistent with China's national conditions, adhere to governance in accordance with the law, and adhere to the scientific outlook on development as a guide.

First, the construction of the rule of law in our country is a construction of the rule of law with the party as the political leadership. This distinctive feature of my country's rule of law construction has never been seen at home or abroad in ancient and modern times. It is an objective fact that is undeniable and cannot be denied. This characteristic objectively raises a major issue, that is, we must not only uphold the party's leadership, but also uphold the party's governance according to law.

Second, my country’s rule of law construction is based on China’s national conditions. From the perspective of social nature and stage of social development, our country is still and will be in the primary stage of socialism for a long time to come. The construction of the rule of law must proceed from the reality of our country, and it must first proceed from this greatest reality. Our country has a large population, poor foundation, and limited resources per capita. Since the reform and opening up, our country has made significant achievements, but overall it is still relatively backward. The national conditions determine that the construction of the rule of law must serve development, catch up, and leapfrog. Development goals require us to serve scientific development.

Third, my country’s rule of law construction is based on Chinese history and culture as the ideological background. Our country's history and culture are generally not conducive to modernization, but we must face it and use it as a starting point. This determines that while we always adhere to economic construction as the center, we must also pay attention to social and cultural development beyond the economy to achieve comprehensive coordination and sustainable development of economy and society. Our historical and cultural foundation is concrete and solid, with distinctive characteristics. In addition, we lack a good understanding of Chinese traditional culture, and historical culture does not affect the construction of the rule of law because of this, and it must be carried out under the premise of this historical culture as the background.

Fourth, my country’s rule of law construction is based on socialism as the social path. The socialist road is the fundamental difference from capitalism. The essence of socialism is to liberate productive forces, develop productive forces, eliminate exploitation, eliminate polarization, and ultimately achieve common prosperity for all. The construction of socialist rule of law with Chinese characteristics must be centered on economic construction and achieve common prosperity for all people. This is completely different from capitalist rule of law. This determines that it accompanies and guarantees the development of the socialist market economy, and ultimately must be people-oriented to achieve the common prosperity of all people. Adhering to the socialist road, effectively realizing that the people are the masters of the country, paying attention to people's livelihood, attaching importance to people's livelihood, and improving people's livelihood must be the mission of our country's rule of law construction.

Fifth, my country’s rule of law construction is based on my country’s modernization as a development carrier. No matter when the construction of our country’s rule of law started, it was almost always intertwined with our country’s modernization drive. They are born together and move with each other. The late-developing nature of my country's modernization also determines the late-developing nature of the construction of the rule of law. The process of my country's modernization is seriously constrained by the dual structure of urban and rural areas. The fundamental purpose of promoting the construction of new rural areas is also to solve this problem, but it is very difficult to solve it. The construction of the rule of law, including in rural areas, is an integral part of my country's modernization drive. As a pilot area for coordinating urban and rural comprehensive supporting reform, Chongqing is working hard to promote urban and rural integration. The integration of the rule of law in rural and urban areas goes hand in hand with their modernization.
