Measures for the supervision and administration of special equipment

The Measures for Safety Supervision and Inspection of Special Equipment is a departmental regulation formulated by the State Administration of Market Supervision according to the Law of the People's Republic of China on Safety of Special Equipment, the Regulations on Safety Supervision of Special Equipment and other laws and administrative regulations in order to standardize the safety supervision and inspection of special equipment and implement the safety responsibilities of production, operation and use units and inspection and testing institutions of special equipment. Applicable to the supervision and inspection of the market supervision and management departments on the production (including design, manufacture, installation, modification and repair), operation and use (including filling, the same below) units and inspection and testing institutions of special equipment.

One, in accordance with one of the following circumstances, should be included in the list of key units:

1, schools, kindergartens, hospitals, stations, passenger terminals, airports, shopping malls, stadiums, exhibition halls, parks, tourist attractions and other public gathering places;

2. The special equipment used in the past two years has had an accident and is responsible for the accident;

3. There are many complaints about the safety of special equipment, which have been verified through investigation;

4. Other circumstances that the market supervision and management department thinks should be included.

Two, special equipment serious accidents, including the following situations:

1, the special equipment has not obtained the production license, the state has explicitly eliminated it, it has been scrapped or reached the scrapping condition, and it continues to be used;

2, special equipment without supervision and inspection or inspection, testing unqualified, continue to use;

3, special equipment safety accessories, safety protection device is missing or invalid, continue to use;

4, special equipment accident or obvious failure, not to conduct a comprehensive inspection, eliminate the hidden dangers of accidents, continue to use;

5. The use of special equipment is beyond the specified parameters and scope of use;

6 other circumstances that the market supervision and management department considers to be a major accident.

Legal basis: Measures for Safety Supervision and Inspection of Special Equipment Article 3 The State Administration of Market Supervision is responsible for supervising and guiding the safety supervision and inspection of special equipment nationwide, and may organize supervision and inspection as needed.

The local market supervision and management departments at or above the county level are responsible for the safety supervision and inspection of special equipment within their respective administrative areas, and organize supervision and inspection according to the deployment of the market supervision and management departments at higher levels or the actual work needs.

The market supervision and management office shall undertake the safety supervision and inspection of relevant special equipment in accordance with the relevant provisions of market supervision laws, regulations and rules and the authority determined by the higher market supervision and management department.
