According to the "Regulations on the Prevention and Control of Pollution from Large-scale Livestock and Poultry Breeding", State Council Order No. 643, which came into effect on January 1, 2014:

Article 13 Livestock and poultry farms and breeding communities shall, based on the scale of breeding and pollution prevention and control needs, build corresponding diversion facilities for livestock and poultry manure, sewage and rainwater, storage facilities for livestock and poultry manure and sewage, and anaerobic digestion and retting of manure and sewage. , organic fertilizer processing, biogas production, biogas residue and liquid separation and transportation, sewage treatment, livestock and poultry carcass processing and other comprehensive utilization and harmless treatment facilities. Those who have entrusted others with the comprehensive utilization and harmless treatment of livestock and poultry breeding waste do not need to build comprehensive utilization and harmless treatment facilities themselves.

Livestock and poultry farms and breeding communities that fail to build pollution prevention and control supporting facilities, that self-built supporting facilities are unqualified, or that fail to entrust others to comprehensively utilize and harmlessly treat livestock and poultry breeding wastes shall not Put into production or use.

If livestock and poultry farms or breeding communities build pollution prevention and control supporting facilities on their own, they must ensure their normal operation.

Article 20 Discharge of treated livestock and poultry breeding waste into the environment shall comply with national and local pollutant discharge standards and total volume control indicators. Livestock and poultry breeding waste shall not be directly discharged into the environment without treatment.

3. Responsibilities to be borne:

Article 37: Anyone who violates the provisions of these regulations and builds livestock and poultry farms or breeding communities in prohibited breeding areas shall be punished by the county level or above The environmental protection department of the local people's government shall order the cessation of illegal activities; those who refuse to stop the illegal activities shall be fined not less than 30,000 yuan but not more than 100,000 yuan, and reported to the people's government at or above the county level for ordering demolition or closure. Anyone who builds livestock and poultry farms or breeding communities in a drinking water source protection zone shall be ordered by the environmental protection department of the local people's government at or above the county level to stop illegal activities and impose a fine of not less than 100,000 yuan but not more than 500,000 yuan, and shall report to the competent authority for approval. With the approval of the people's government, it shall be ordered to be demolished or closed.

Article 39 Violates the provisions of these Regulations by failing to build pollution prevention and control supporting facilities or by failing to construct self-constructed supporting facilities that are unqualified, or by failing to entrust others to comprehensively utilize and harmlessly treat livestock and poultry breeding wastes. If a livestock and poultry farm or breeding community is immediately put into production or use, or if the pollution prevention and control supporting facilities built are not operating normally, the environmental protection department of the people's government at or above the county level shall order it to stop production or use, and may impose a fine of not more than 100,000 yuan. .

Article 40 Anyone who violates the provisions of these Regulations and commits one of the following acts shall be ordered by the environmental protection department of the local people's government at or above the county level to stop the illegal act and take control measures to eliminate pollution within a time limit. In accordance with the "People's Republic of China" The relevant provisions of the "Law of the People's Republic of China on the Prevention and Control of Water Pollution" and the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Waste" shall be punished:

(1) Using livestock and poultry breeding waste as Fertilizer exceeds the land's absorption capacity and causes environmental pollution;

(2) Engaging in livestock and poultry breeding activities or livestock and poultry breeding waste disposal activities without taking effective measures, resulting in the seepage of livestock and poultry breeding wastes , leaked.

Article 41 The discharge of livestock and poultry breeding waste does not comply with the pollutant discharge standards or total quantity control indicators stipulated by the state or local government, or the livestock and poultry breeding waste is directly discharged into the environment without harmless treatment If a property is damaged, the environmental protection department of the local people's government at or above the county level shall order it to be rectified within a time limit and may impose a fine of not more than 50,000 yuan. After the environmental protection department of the local people's government at or above the county level makes a time-limited governance decision, it shall promptly verify the implementation of the rectification measures in conjunction with the agriculture and animal husbandry and other relevant departments of the people's government at the same level, and announce the verification results to the public.
