Measures for the Administration of Closing Reservoirs and Cancelling Numbering in Guizhou Province (for Trial Implementation)

Chapter I General Provisions

Article 1 In order to standardize the management of the closure and revocation of tailings ponds in our province, these measures are formulated in accordance with the provisions of relevant laws, regulations, rules, standards and norms, and in accordance with the requirements of the Notice on Printing and Distributing the Work Plan for Preventing and Resolving the Safety Risks of Tailings Ponds (Emergency [2020]15), combined with the actual situation in our province.

Article 2 The term "tailings pond" as mentioned in these Measures refers to the place where tailings are discharged after mineral processing in metallic and nonmetallic mines, including red mud storage and phosphogypsum storage, excluding the tailings pond in nuclear industry mines and ash storage in power plants.

Article 3 These Measures shall apply to the management of the closure and revocation of tailings ponds within the administrative area of this province.

Article 4 The closure and revocation of tailings ponds shall be the responsibility of the original production and business operation units. For the dissolution or closure of bankrupt production and business units and closed or abandoned tailings ponds, the investors of the production and business units or their superior competent units shall be responsible for the closure and cancellation. If there is no superior competent unit or the investors are unclear, the emergency management department shall report to the people's government at the county level to designate a management unit to be responsible (the above-mentioned unit, hereinafter referred to as the tailings management unit).

Fifth tailings management units should ensure that the tailings closed, cancellation of capital investment.

Article 6 The people's governments at or above the county level shall be responsible for the emergency management, natural resources, ecological environment and other functional departments of the tailings pond supervision and management (hereinafter referred to as the tailings pond supervision and management department), establish an information sharing mechanism for tailings ponds, cooperate closely according to the division of responsibilities, and strengthen the management of tailings pond closure and revocation.

Article 7? The tailings pond shall be reported to the people's government at the county level by the emergency management department at the county level to announce the implementation of cancellation number.
